4、 Party A使用说明 Instructions for use一、本合同文本是根据中华人民共和国民法典、建设工程质量管理条例等法律法规制定的示范文本，供双方当事人约定采用，签订合同前请仔细阅读。1. The text of this contract is a model text formulated in accordance with the Contract Law of the Peoples Republic of China, the Regulations on the Quality Management of Construction Projects, and oth
5、er relevant laws and regulations for the purpose of the parties reference to adopt. Please read it carefully prior to signing the contract.二、签订合同前委托人应验看检测机构的企业法人营业执照、检测资质证书、检测机构评估证书等相关证明文件。开展平行检测的检测机构的能力等级不得低于建设单位委托的检测机构的能力等级。2. The client should, prior to conclusion of the contract, check the inspe
6、ction agencys Business License of Enterprise Legal Person, Inspection Certificate, Assessment Certificate for inspection Agency and other relevant supporting documents. The level of competence of the inspection institute carrying out parallel inspection shall not be lower than the level of competenc
7、e of the inspection institute commissioned by the construction unit.（七）检测项目属于工程实体检测的，甲方应提前日将现场检测日期通知乙方。见证人员应对工程现场检测进行见证，并在现场检测原始记录上签字确认。(7) Provided that the inspection project is a physical inspection of the project, Party A shall, prior todays, notify Party B of the date of on-site inspection. Wit
8、nesses personnel shall witness the on-site inspection of the project and sign on the record of original on-site inspection to confirm.（八）甲方应当负责与本工程检测业务有关的第三人的协调，为乙方提供必要的外部工作条件。(8) Party A shall be responsible for the coordination of third parties related to the inspecting business of the Project and
9、 provide Party B with the necessary external working conditions.（九）甲方不得以任何方式要求乙方出具虚假检测报告。(9) Party A shall not in any way require Party B to issue a false test report.第七条乙方的权利义务 Article 7 Rights and obligations of Party B（一）乙方应向甲方提供与本工程检测业务有关的资料，包括建设工程检测资质证书、检测机构评估证书及其附表等复印件。(1) Party B shall provid
10、e Party A with information relating to the inspecting business of the Project, including copies of the Certificate of Construction Inspecting Qualification, the Assessment Certificate of Inspecting Agency and its schedules, etc.（二）乙方承诺与行政机关、法律法规授权的具有管理公共事务职能的组织以及本工程相关的建设单位、设计单位、施工单位、监理单位无隶属关系或者其他利害关
11、系。(2) Party B undertakes to have no affiliation or other interest with administrative organs, organizations authorized by laws and regulations to manage public affairs, as well as construction units, design units, construction units and supervision units related to this project.（三）乙方在同一建设工程项目或标段中，不得
12、同时接受建设、施工或者监理单位等两方以上的检测委托。(3) Party B in the same construction project or bid section shall not simultaneously accept the units of the employer, constructor or supervisor, such as more than two parties to inspect the commission.（四）乙方应当按照合同约定的标准进行检测，并对检测数据和检测报告的真实性和准确性负责。(4) Party B shall carry out t
13、he inspecting in accordance with the standards specified in the contract and shall be responsible for the authenticity and accuracy of the inspecting data and test reports.（五）检测项目属于工程实体检测的，乙方应事先编制检测方案报送甲方。(5) Provided that the inspection project is a physical inspection of the project, Party B shall
14、 prepare the inspection schedule in advance for submission to Party A.（六）检测项目属于工程实体检测的，乙方应在甲方通知的日期进场开展检测活动。(6) Where the inspection project is a physical inspection of the project, Party B shall enter the site on the date notified by Party A to carry out the inspection activities.（七）乙方现场检测时应遵守工程安全管理
15、及其他工程现场管理制度。(7) Party B shall, during on-site inspection, comply with the project safety management and management systems of other project site.（八）对依据相关法律、法规、规章和技术标准实施的建设工程法定检测项目，乙方应使用检测信息系统实施检测，并出具带有防伪标记和校验码的检测报告。(8) For the statutory inspection projects of construction works implemented in accord
