3、国目前的土地产权制度体制下,农村土地征收成为缓解土地供求矛盾,保证经济快速发展的重要途径。农村土地征收就其本质而言即为权力与权利的博弈,通过权力获得权利必须依靠程序的保障,但由于我国农地征收程序固有的缺陷以及配套制度的缺失,以致于农地征收实践中规避程序、简化程序等现象不断,导致农村土地征收过程中纠纷频频。因此,完善我国农村土地征收程序制度具有迫切的现实和理论意义。本文以我国的土地征收程序为对象,主要从以下四个部分予以论述：第一部分主要是关于土地征收程序的基本理论。该部分在对土地征收及土地征收程序的概念及特征进行界定的基础上,对土地征收程序制度的理论基础进行了深入的剖析。第二部分对各国的土地征收
4、程序进行考察。该部分分别对法国、德国、日本、美国以及英国的土地征收程序进行介绍,并揭示出两大法系国家土地征收程序设计的共同趋向。第三部分对我国土地征收程序进行检讨。该部分首先对我国土地征收的审批程序、实施程序以及救济程序的相关规定加以介绍,然后总结了我国土地征收程序实施过程中的失范表现,进而指出我国土地征收程序在立法上的缺失。第四部分是我国土地征收程序的完善。该部分从土地征收程序完善应当遵循的原则入手,进而对完善我国土地征收程序提出一系列具体建议。关键词： 土地征收；程序；缺陷；完善1.AbstractWith the economy rapidly and the urbanization
5、deeply, the contradiction between supplyand demand of the land is appearing. With the Chinese land ownership system now, the landexpropriation is an important way to alleviate the contradiction and ensure the economy todevelop rapidly. The essence of the land expropriation is the competition of the
6、power and theright. Rights get from the power must rely on process. Because Chinas land expropriationprocedure has inherent defect and lack the supporting systems, going against and avoidingand simplified the procedures happen frequently. So the disputes in the process of the landexpropriation occur
7、s often. Therefore, improving our countrys land expropriation proceduressystem has theoretical and practical significance. I will discuss the land expropriation as theobject through the following four aspects:The first part is about the basic theory of the land expropriation procedure. In this part,
8、 theconception of the land expropriation and the land expropriation will be defined . Based onthese conceptions, the basic theory of the land expropriation procedures system will bediscussed.The second part is about the investigation of other countries land expropriation procedurein the world, such
9、as the expropriation procedure in France, Germany, Japan, the UnitedStates. Based on these introduce, I will summarize the common trend of the differentcountries of two important legal systems about the process of land expropriation.The third part recommends our countrys land expropriation procedure

Firstly, I willintroduce the examination and approval procedure, implementation procedure and reliefprogram; secondly,I will summarize the behavior out of the procedure in the practice; in thelast,I will point the defect in legislation.The fourth part is about improving the land expropriations pr
