3、文研 究 的行政信 访是信 访 的重要 组 成 部 分 ，兼 具权利救济 与 民意表达 的双 重职 能。20 世 纪 90 年 代 以来 ，随着 城 乡社会 结 构 的变动 ，社会 阶层 的分 化 ，我 国 出现了一个 结构 复杂 、人 数 庞 大 的社 会 弱势 群 体 ，这 个群 体在 社 会 各方 面 的权 利 实现中遇 到 了多种 问题 。在 社 会 保障 体 系不 完 善 的今天 ，弱势 群 体 的利益 诉 求 很 难通过 行政 复议 和 行政 诉 讼 这 两种 救 济途 径解 决 ，大量 争议 涌 向信 访渠道 。尽管 行政信访 在 协 调 利益 纠 纷 上 发挥着 不 可 估 量
4、 的作 用 ，但 是 由于 社 会 赋予 行政 信访 的责任远 大于它 所 能承 受 的范 围 ，导致 社会 深层 次 的矛盾 凸显 ，群 体性 事 件频频 发 生 。如何 协调 社 会 各 阶 层 的 利 益关 系 ，逐 步 形 成 较 为 合 理 的社 会 利 益 关 系 结 构 ， 为 弱势群 体 在 一 定领 域 和 程 度 上 提 供 直 接 民主 的沟 通 渠道 ，并将 行 政 信 访 作 为 一 种 替代 性 纠 纷 解 决机 制 ，为 不 良行 政提 供法 律 外 救 济 ，弥补 法 律 制 度 和 法 律 救 济 的 局限性 。本 文共 分 四个 部分 ：第 一章 从对 我
5、国信 访 制 度 设立 、发展 谈 起 ，分 析 了其 主 要 功 能 的转变 ，从 传达 民意 到检举 揭 发 ，从提 出建 议到化 解 纠 纷 ，而其 权 利救 济 只是在 特 殊 时期 被 赋予 的一种 功 能 ，但这 种 功 能在 当今 社会成 为 民众 对 不 良行政 投诉 的主要救 济 渠 道 。基于弥补 司法救 济途 径 的局 限和 “民主行政 理论 ”的发展 ，本文认 为行政信 访 应该具有权利救济 的功 能 。第 二 章 通 过 分 析 我 国 的弱 势 群 体 的特 征 、受侵 害 的群 体 基 本 形态 ，得 出现 行行政诉讼和行政 复议制度 对弱势群 体权利 的救济存在
6、严重 的救 济不能 。 由于 弱势群体其 自身 的特 点 ，表 现 出 了对 行 政信 访 的极 大依 赖 。但 是 行 政信 访 本 身 也 存 在着作 为救济手段 的缺 陷 ，使弱势群 体维权面 临极大 的 困境 。大泮 师 范 人学 法律 硕十 （ JM ) 研 究 生学位 论文第三章 由于 国外 有 完 善 的对 弱势 群 体保护 的法 律 体 系和 社会 保 障体 系 ，因此没有 专 门针 对 弱 势 群 体 的行 政 救济 机制 。本 文通 过研 究类 似 于我 国行 政信 访制度的监 打制度 ， 比较 各 丨 ( 丨 监 察制度 运 行 的 实 效和 该制度 在 民众 权 利 救
7、 济 上的 屯处作 川 ， 对 比 。我 丨丨 彳 r政制度 的优 势 ， 分 町我 N 行政 仿 U在 对弱 势 群 体权 利 救 济 制 度 上 的 A!小 。第 四章通 过 介 绍 我 国 已有 的政 治 体制 下 对 行政 信 访 改革 的不 同观 点 ，探 讨 我国行 政 信 i 方制 度 的改革 。本 文试 图在 已有 的体制 下准 确 定位 行政 信 访 的功 能 ，即一种 以监 督权 为主 的请 愿 权 制度 ，并对遭 受 不 良行政 行为 的群 体具 有 一定 的补充救济 功 能 ，弥 补行政 、司法 救 济 的不足 。通 过 解 决信 访职 能机构 设 置 ，建立 统 一的
