4、签名：导师签名： 年年 月月 日日 I 摘摘 要要 国际工程项目管理的关键，是对质量、工期和费用的识别和控制。识别主要 体现在承包商投标报价时对工程质量和进度的评估，在风险识别的基础上提出合 理的报价。目前国际工程领域主要呈现买方即业主主导的市场状态，承包企业同 质化严重，竞争异常激烈，以压低价格夺得标的手法被广泛使用， “价格战”使 得项目管理“三角形” （质量、工期和费用）在工程启动之初就丧失了平衡。因 此，如何在项目施工过程中实现对质量、工期和费用的有效控制就成为了承包商 们唯一能做且必须做好的功课。索赔是承包商在施工过程中利用经济杠杆进行项 目管理的一种手段，使工期和费用两因素及时和质
5、量因素保持协调，避免短板。 可以说，指挥好索赔杠杆对于我国承包商收回损失、平衡利润，实现在海外市场 的可持续发展十分重要。 菲迪克（全称“国际咨询工程师联合会” ，FIDIC）成立已有一百年，成员协 会遍布全球各地七十余个国家，在国际工程咨询行业中得到广泛承认和实施，特 别是涉及到世界银行贷款的项目和引进外资的项目，均要求采用菲迪克合同作为 保障。因此，在菲迪克合同条件的大背景下，培养和训练承包商了解、理解、掌 握和运用索赔这一方式刻不容缓。 本文主要分为五个部分，第一部分对菲迪克合同进行概述，介绍菲迪克合同 的含义、特点、产生发展，以及在我国的适用情况。第二部分介绍菲迪克索赔的 概念、性质和
6、特点，第三部分对菲迪克索赔的起因进行分析，包括工程变更、业 主违约和不可抗力等情况，第四部分理顺菲迪克索赔的程序，明确每一步程序的 内容和意义，第五部分对我国承包商索赔工作提出建议。本文按照逻辑顺序，在 菲迪克索赔实体和程序研究的基础上，以我国承包商在实践中出现的经验教训为 例，提出既合法合理，又行之有效的索赔工作建议。 本文采用了文献研究方法，实证分析法，历史分析法，比较法。笔者亲身深 入我国国内大型工程承包企业，通过重点访问和深度访问的方式，调研获取真实 可靠的第一手资料。同时，在对国内外学术成果和案例资料的处理上，遵从文献 研究方法和比较法，将工程材料中诸如技术数据等次要信息剥离，从法学
7、层面和 商务角度上予以提炼和升华，最终得出索赔工作的策略和建议。 关键字：菲迪克索赔，索赔，承包商索赔，国际工程 II Abstract The key of international project management is the identification and control of quality, duration and cost. Identification exists during the contractors bidding process, which the contractor concludes the reasonable offer based on
8、 the risk identification and assessment of project quality and progress. Current international engineering market mainly presents buyer-employer dominated state, contracting enterprises are highly homogeneous and competition is extremely serious, as a result, “price war” is widely used to win the bi
9、dding, which made the project management “triangle” loses balance at the beginning of the project. So, how to effectively control the quality, duration and cost during the construction process become the only can do and must do homework for contractors. Claim is one of the project management means e
10、ffects by economic leverage, to make the duration and cost factor coordinate with quality factor and avoid weakness. We can say that a good command of the claim leverage is pretty important for our domestic contractors to recover loss, balance profit, and realize the sustainable development in the o
11、verseas market. FIDIC( full name of “Fdration Internationale des Ingnieurs Conseils”) has been established for over 100 years, membership numbers more than 60 countries from all parts of the globe, the FIDIC contracts has been widely recognized and implemented in the international engineering consul
12、ting industry, particularly in relation to the World Bank loan projects and foreign capital introduction projects, all require the adopt of FIDIC contracts as a guarantee. Therefore, under the FIDIC conditions of contract background, cultivating and training contractor know, understand, master and a
13、pply the claims is without delay. This paper is divided into five parts, the first part generally overviews the FIDIC concept, features, development and application in our country. The second part introduces the concept of FIDIC claims, its nature and characteristics. The third part analyzes the cau
14、ses of FIDIC claims, including project variation, employers default and force majeure circumstances. The fourth part clears the FIDIC claim procedure, answers the content and meaning of each step. The last part make recommendations on the domestic contractors claim work. This paper adopts literature
15、 research method, empirical analysis, historical analysis method, comparative method. I personally visited Chinas large domestic engineering contracting enterprises, made research by focused and in-depth interview and got real and reliable first-hand information. Meanwhile, in the case of domestic a
16、nd foreign academic achievement and cases process work, complied with literature research method and comparative method, stripped secondary information such as technical data from materials, refined and sublimates the rest from legal and business level, so as to ultimately draw the strategies and recommendations for claim work.
