1、烟台大学硕士学位论文非全日制用工若干法律问题研究姓名:卢增峰申请学位级别:硕士专业:经济法学指导教师:王海英2011-03-12I摘 要 非全日制用工制度是在我国市场经济快速发展、就业形式日益严峻的大背景下发展起来的一种新型的用工形式。灵活性和短期性特点决定了该制度常见于餐饮、超市、家政等服务性行业,目前已有越来越多的用人单位开始关注这一用人制度。然而,当前现行劳动立法大部分是以全日制用工为调整对象,对于非全日制用工的规定少之又少,难以保障非全日制劳动者的合法权益,增加了用人单位的用工风险,挫伤了他们的用工积极性。因此,研究非全日制用工的相关问题具有重要的现实意义。 全文约三万字, 共分为三个

2、部分, 对非全日制用工中经常遇到的三个问题进行了深入研究,并提出了一些完善建议。 第一章,非全日制用工的超时用工问题研究。首先,该章介绍了超时用工的表现形式:一方面是由于用人单位方面原因导致,另一方面是由于劳动者方面原因导致;其次,提出了目前实际操作中对超时用工的性质认定:有的认定为全日制用工,有的认定为加班加点;最后,针对超时用工的处理方式提出了笔者的一些建议:根据所超时间长短分为三种情况区别对待:一是按照全日制用工对待,二是按照加班加点对待,三是自由选择前两种方式之一对待,既保护非全日制劳动者的合法权益,又促进用人单位的用工积极性。 第二章,非全日制用工的合同形式问题研究。首先,该章分析了

3、非全日制用工合同形式的立法现状;其次,分别介绍了书面劳动合同和口头劳动合同的利弊,将二者加以对比,使人们对劳动合同的形式有了更加清晰明了的认识;最后,提出了我国非全日制用工合同形式的重新选择:非全日制用工合同的形式应当以书面形式为原则,以口头形式作为补充。一般情况下,当事人双方应当尽量采用书面合同形式,而只有在合同期限较短,双方权利义务明确的情况下,经双方同意,才可以选择口头合同形式。 第三章,非全日制劳动者的社会保险问题研究。首先,该章分析了非全日制劳动者社会保险中存在的诸多问题:一是当前我国立法的模糊和相关政策的缺失;二是社会保险的管理水平不到位;三是非全日制劳动者的参保比例较低;四是社会

4、保险II缴费标准过高、缴费方式单一;五是社会保险关系极易中断、难以接续和转移;其次,针对存在问题,提出应因对策:一是加强社会保险立法,推进保险制度建设;二是改进技术手段,提高管理服务水平;三是调整社会保险政策,完善各项保险措施;四是加快具体险种设计,充分享受保险待遇;五是完善政府扶贫措施,加强社会救助工作。通过实施这些解决方案,为非全日制劳动者提供了完备的社会保险,从而使他们真正享受到保险利益。 关键词:关键词:非全日制用工;超时用工;合同形式;社会保险 IIIAbstract Part-time employment system is the rapid development of Ch

Chapter III, part-time workers of social insurance.First, the chapter analyzes the social insurance part-time workers in the existence of many problems: Fi
