3、形式上已经建立起一套相对完整的法律体系可是却没有实现西方式的法治。我国在法律实施过程中存在诸多问题究其原因是因为我国在立法时忽略本国的本土法律资源即中国传统法律制度和文化以及在此基础上积累起来的人们的行为规范、行为模式和法律观念。本文从研究荀子法律思想入手来探究荀子法律思想对中国传统法律文化的影响，从而在以后的法律实践中无论立法还是执法都要注重从本土资源中汲取营养，更加重视本国的传统文化，寻找现代法治与中国法律传统的一个契合点，给予社会主义法治及实践以有益的启示。荀子作为战国时期著名的儒学泰斗，他为解决当时社会战乱不断的现实问题创造性地将儒家之“礼”与法家之“法”结合起来，提出著名的“隆礼重法

4、”观点，形成独特的思想理论体系,确立了我国传统法律思想的框架，成为我国两千多年封建社会的思想范式,甚至影响中华法系的发展方向。本文共分为三部分：第一部分，简述荀子法律思想的产生，主要从荀子法律思想产生的背景和内涵来论述；第二部分，分析荀子法律思想的影响，从荀子法律思想对正统法律思想的影响和后世法律思想观念的影响两方面分析；第三部分，解析荀子法律思想的当代价值。本文的重点是荀子法律思想的当代价值，主要从以下几个方面进行探析：在法律观念上，荀子的“隆礼重法”思想培植了“以法为本，法律至上”的意识，增强了民众的现代法治意识；在立法层面，立足现实，礼法结合，促进法律制度体现社会主义道德精神；在司法层面
