3、育作为非义务教育，缴 费上学的观念随着我国市场经济体制的建立和高等教育管理体制改革的深入发 展，已逐渐得到国人接受。高等学校收费工作事关广大人民群众的切身利益，事 关高等学校的健康发展，事关社会稳定的大局。一方面，一些高校存在着提高或 变相提高收费标准、擅立收费项目等问题，阻碍教育与社会的协调发展，引发许 多教育问题和社会问题。另一方面，对高校收费的规制相对乏力，规制高校收费 的各项制度，尤其是法律制度方面显得落后和不完善。高校收费的法律规制问题 也逐渐为人们切实关注，以望高校收费走向“正轨” 。 本文通过高等教育收费的 依据分析、高校收费的行为分析、高校收费的现实问题和法律规范问题，推出有
4、必要去以法律的方式去规制高校收费行为，这样一个逻辑脉络贯穿全文，使得文 章的内容更加丰富、 结构更加紧密、 结论更具有说服性。 本文一共分为四个部分。 第一部分首先探讨了高校收费的理论依据的现实依据。介绍了关于高校收费 依据的主要理论学说，并加以评析，认为我国高校收费的理论依据主要是高等教 育成本分担理论；再立足于现实国情，从我国高等教育收费改革和高等教育财政 体制方面，分析我国高等学校收费的现实性，回答高等教育为什么要收费。 第二部分开始展开对高校收费行为的内部剖析，通过高校作为收费主体的法 律性质分析，了解高校在收费过程中扮演一个什么样的角色，处在一个怎样的地 位；接着以此为前提继续分析了
5、解高校收费行为的法律性质，认清高校收费的性 质问题。 第三部分首先从实际着手分析高校收费的现状，了解我国高校的收费现状； 其次，分析了解我国在规范高校收费的法律以及法律制度方面存在的一些问题， 以此说明高校收费法律规制的必要性。 第四部分是高校收费法律规制部分，是本文的重点部分，也是前几个部分的 逻辑结论。主要从高校收费的设定权、高校收费行为行使、违法收费行为的责任 承担及对违法行为造成损害的救济几个方面，论述高校收费的法律规制的完善。 关键词：关键词：高校；收费行为；法律规制 I Abstract University fees are an important issue in highe
6、r education，since the fees for higher education, colleges and universities fees has been a hot topic。As a non-compulsory education, the concept of school fees, has been gradually accepted, as the establishment of Chinas market economic system and the in-depth reform of the management system of highe
7、r education 。 Colleges and universities fees related to peoples interests, related to the healthy development ，and related to the stability of society。On the one hand, there are a number of colleges and universities raise fees or raise standards in disguise and so on, which is impeding the coordinat
8、ion of education and social development, causing many educational and social problems. On the other hand, the University charges a relatively weak regulatory system, regulation of the university fees system, in particular the legal system is imperfect and backward。People truly concern about the univ
9、ersity fees issue of Legal Regulation， and look to a normal college fees。Through analysis of the basis for charging higher education, colleges and universities charge of analysis, the reality of college fees and legal norms, it is necessary to launch a legal way to regulate the system of university
10、fees。Such logic runs through the full text, making the article further enrich the content, structure more closely and concluded more persuasive. This article has divided into four parts.
