1、国际贸易合同中的装运条款国际贸易合同中的装运条款SHIPPINGCLAUSE装运条款主要包括装运港和目的港、装运期、是否允许分批装运与转船、装运通知、装卸时间、装卸率、滞期和速遣等多个单项条款L装运港Portofshipmen/Portofloading和目的港条款PortofDestination/discharge例如：装运港：天津Portofshipment:Tianjin目的港：鹿特丹PortofDestination:Rotterdan2、装运期TimeofShiPment例1规定具体的装运月份2003年3月装运shipmentduringMarchz2003例2规定一段装运时间20
2、03年3月5日至20日装运shipmentfromMarch5-20z20033、分批装运PartialShiPment与转船TranSShiPment例1允许分批装运。允许转运Partialshipment&Transshipment例24/5/6月份每月装一批，每批数量相等shipmentinApr/May/Junein3equalmonthlylots4、装运通知shippingAdvice例如：货物全部装船后，卖方应立即将合同编号、商品名称、数量、毛重、发票金额、船名及开航日期电告买方。如由卖方未及时将装运通知电告买方，以致货物未及时保险而发生的一切损失由卖方承担。(Immediate

7、货仓或按可供货仓数量的比例装货。每日的速遣费为600美元，滞期费为1200美元Sellersguaranteetoload700MTperWD(weatherworkingdays)forallhatcheszorprorateaccordingtoavailabilityofhatches.DispatchatUS600perdayandDemurrageatUS1200perday.本合同所定货物一经装运，应即以电报通知买方。Shipmenteffectedunderthiscontractshallbepromptlyinformedtothebuyerbyable.提单日期应作为装运期

9、30.3月份装运100公吨，4月份装运100公吨。Shipment100M/TduringMarchand100M/TduringApril.8-9月份分两批平均装运。ShipmentduringAugust/Septemberintwoequallots.四、装运术语立即装运shipmentimmediately尽快装运shipmentASAP装运港：上海(portofshipment:Shanghai)目的港：伦敦，允许在香港转船portofdestination:London.TranshipmentatHongKongallowed.五、载运货物的船只安排载运船只由卖方安排，允许分批载
10、运及转船。卖方于货物装船后，应将合同号码、品名、船名、装船日期以电报通知买方。Thecarryingvesselshallbeprovidedbythesellers.Partialshipmentandtransshipmentareallowed.Afterloadingiscompleted,thesellershallnotifythebuyersbycableofthecontractednumber,nameofcommodity,nameofthecarryingvesselanddateofshipment.ex与Per源自拉丁语的介词ex与per有各自不同的含义。英译由某轮船
11、运来的货物时用ex,由某轮船运走的货物用Per,而由某轮船承运用byo由维多利亚轮运走/运来/承运的最后一批货将于10月1日抵达伦敦。Thelastbatchper/ex/byS.S.VictoriawillarriveatLondononOctober(S.S.=Steamship)装运条款TermsofShipmentFoB交货方式卖方应在合同规定的装运日期前30天，以_方式通知买方合同号、品名、数量、金额、包装件、毛重、尺码及装运港可装日期，以便买方安排租船/订舱。装运船只按期到达装运港后，如卖方不能按时装船，发生的空船费或滞期费由卖方负担。在货物越过船弦并脱离吊钩以前一切费用和风险由卖
12、方负担。TheSellershallz30daysbeforetheshipmentdatespecifiedintheContractadvisetheBuyerbyoftheContractNo.zcommodity,quantity,amount,packages,grossweight,measurementandthedateofshipmentinorderthattheBuyercancharteravessel/bookshippingspace.IntheeventoftheSellersfailuretoeffectloadingwhenthevesselarrivesdu
13、lyattheloadingport,allexpensesincludingdeadfreightand/ordemurragechargesthusincurredshallbefortheSellersaccount.(2)CIF或CFR交货方式卖方须按时在装运期限内将货物由装运港装船至目的港。在CFR术语下，卖方应在装船前2天以_方式通知买方合同号、品名、发票价值及用台日期，以便买方安排保险。TheSellershallshipthegoodsdulywithintheshippingdurationfromtheportofloadingtotheportofdestination.
14、UnderCFRterms,theSellershalladvisetheBuyerbyoftheContractNo.zcommodity,invoicevalueandthedateofdispatchtwodaysbeforetheshipmentfortheBuyertoarrangeinsuranceintime.卖方应在每一包装箱相邻的四面用不可擦除的油漆和明显的英语字样做出以下标记：TheSuppliershallmarkthefollowingonthefouradjacentsidesofeachpackagewithindeliblepaintinconspicuousEn
15、glishprintedwords;六、溢短装Quantity,unlessotherwisearranged,shallbesubjecttoavariationof5%plusorminusatSeller7soption.量：除非另作安排，量可由卖方选择作加或减5%的变动。Thesellerhastheoptionofdelivering5%moreorlessofthecontractedquantity.买方有权决定按合同数量增减5%Shouldtheweightascertainedasaresultofreweightingthegoodsattheportofdestinati
16、ondifferfromthebillofLadingweightbyuptoonepercentmoreorIesszthebillofLadingweightshallbedeemedfinalforthesettlementofaccountsbetweentheparties.在目的港对货物再次所得的重量，如与提单重量相差仅1%增减，则提单重量作为上方结算的最后依据。Netshippingweight;lossinweightexceeding(orover)5%tobeforSellersaccount.以装运净重为准，如重量损耗超过5%,超过部分由卖方负担。WhentheSellerdeliverstothebuy
