1、 不转移证书承诺书篇一：资质证书承诺书 上海市房地资源系统行政许可告知承诺格式文书 承 诺 书 房地产开发企业暂定资质申请专用 上海市房屋土地资源管理局关于房地产开发企业实行告知承诺制度的实施方案 一、适用范围 房地产开发企业经工商设立后，向房地产主管部门备案，领取暂定资质证书 二、办理部门 外商投资企业由市局业务受理处办理； 内资企业由区县局业务受理处办理。 三、办理程序 1、企业从业务受理处或网上获取告知内容、行政许可申请表。告知内容包括许可依据、申请条件、申请资料、办理程序、期限、承诺格式文书及从事房地产开发经营所应当遵守的法律、法规和规章； 2、企业通过房地产市场管理信息系统填报有关信
2、息； 3、企业向业务受理处提交行政许可申请表、申请资料、签署后的承诺格式文书； 4、业务受理处收件后，当场审核、制证。 房地产权籍和交易管理处 二四年四月十四日本局就核发房地产开发企业暂定资质证书告知如下： 一、法规依据 1、城市房地产开发经营管理条例（国务院今第248号）第八条； 2、房地产开发企业资质管理规定（建设部令第77号）； 3、上海市工商行政管理局、上海市房产管理局关于房地产开发企业设立和备案有关问题的通知（沪工商登（95）第4号） 二、条件 1、注册资本不低于500万元； 2、有中级以上职称的建筑、结构、财务、房地产及有关经济类的专业管理人员不少于5人 三、提交资料 1、房地产开
3、发企业资质申报表 2、房地产开发企业资质申请告知承诺书 3、房地产开发企业营业执照 4、房地产开发企业章程 5、外商投资企业批准证书 6、会计师事务所出具的验资证明 7、房地产企业法人代表的身份证明 8、专业技术人员的资格证书及其聘用合同 四、行政管理要求 1、房地产开发企业应当自领取营业执照之日起30日内到市局（外资企业）或注册所在地区县局（内资企业）备案，本局向符合条件的企业核发暂定资质证书；未取得房地产开发企业暂定资质证书的企业从事房地产开发经营的，由本局责令限期整改，处5万元以上10万元以下的罚款。逾期不改正的由本局吊销暂定资质证书，并提请工商行政管理部门吊销营业执照。 2、暂定资质证
4、书有效期1年。本局可以视企业经营情况延长暂定资质证书有效期，但延长期限不得超过2年。 自领取暂定资质证书之日起1年内无开发项目的，暂定资质证书有效期不得延长 3、房地产开发企业应当在暂定资质证书有效期满前1个月内向本局申请核定资质等级。 4、企业发生分立、合并的，应当在向工商行政管理部门办理更手续后的 30日内，到本局申请办理资质证书注销手续，并重新申请资质等级。 5、企业变更名称、法定代表人和主要管理、技术负责人，应当在变更30日内，向本局办理变更手续。 6、房地产开发企业的资质实行年检制度。对于不符合原定资质条件或者有不良经营行为的企业由本局予以降级或者注销资质证书。 五、不实承诺应承担的
