3、商业模式、政府行为模式的变迁带给当下个人信息保护以巨大挑战，加之我国正处于社会转型期，而又未构建有专门的个人信息保护制度，因此，研讨适合国情、时代背景的个人信息保护保护制度是十分必要的。本课题首先分析了大数据技术背景下个人信息保护的困境，介绍了大数据挖掘技术的特点与运用。其后，本文比较研究了欧、美、日本的相关法律制度，并研讨了他国立法经验对我国制度够艰难的启示。最后，本文提出了构建大数据时代个人信息保护制度的新思路，及具体制度建议。关键词：大数据，数据挖掘，个人信息保护，利益衡平I重庆大学硕士学位论文英文摘要ABSTRACTWith the rapid development of Inter
