3、三百零二条 承运人应当对运输过程中旅客的伤亡承担损害赔偿责任，但伤亡是旅客自身健康原因造成的或者承运人证明伤亡是旅客故意、重大过失造成的除外。 3.随身财物的过错责任（303条） 第三百零三条 在运输过程中旅客自带物品毁损、灭失，承运人有过错的，应当承担损害赔偿责任。 旅客托运的行李毁损、灭失的，适用货物运输的有关规定。 （二）货运合同 1.货运合同，承运人有三项免责事由。 货物的毁损、灭失是因不可抗力的原因造成的； 货物的毁损、灭失是由货物本身的自然性质或者合理损耗造成的； 货物的毁损、灭失是由托运人、收货人的过错造成的。 2.货运合同，不可抗力造成的损失，货物损失与运输费用分担。 3.单式

5、者武装冲突； （5）政府或者主管部门的行为、检疫限制或者司法扣押； （6）罢工、停工或者劳动受到限制； （7）在海上救助或者企图救助人命或者财产； （8）托运人、货物所有人或者他们的代理人的行为； （9）货物的自然特性或者固有缺陷； （10）货物包装不良或者标志欠缺、不清； （11）经谨慎处理仍未发现的船舶潜在缺陷； （12）非由于承运人或者承运人的受雇人、代理人的过失造成的其他原因。 3.承运人的责任期间 集装箱货物：收到交。是从装货港接收货物起至卸货港交付货物时止，货物在承运人掌管之下的全部期间。非集装箱货物：舷至舷。是从货物装上船时起至卸下船时止，货物处于承运人掌管之下的全部期间。 在责
6、任期间发生货物灭失或损坏，除非法律另有规定，承运人应当负赔偿责任。 4.迟延交付的责任 除法律规定承运人不负赔偿责任的情形外，由于承运人的过失，致使货物因迟延交付而灭失或者损坏的，承运人应当负赔偿责任。即使货物没有灭失或者损坏，但货物因迟延交付而遭受经济损失的，承运人仍然应当负赔偿责任。 5.承运人与实际承运人的责任分担 如果承运人将运输的部分或全部委托给实际承运人履行，承运人仍须按照法律规定对全程运输负责。但如果在海上货物运输合同中已经明确规定了特定部分的运输由特定实际承运人承担，合同可以同时规定，承运人对这一部分运输期间货物的事故不负责任。承运人与实际承运人都负有赔偿责任的，应当在此项责任
