2、siderationnCompetent PartiesnLegal PurposenLegal Form3订立的原则n保险法n第十一条 订立保险合同,应当协商一致,遵 循公平原则确定各方的权利和义务。n 除法律、行政法规规定必须保险的以外 ,保险合同自愿订立。 4自愿的原则 n所谓强制保险又称法定保险,是指由法律规 定必须参加的保险,强制保险通常是对少数 危险范围较广,影响人民利益较大的保险标 的实施。强制保险必须在法律、行政法规规 定的范围内方得实施,法律、行政法规未作 规定的,都应是自愿保险的范畴,由投保人 自行决定是否参加,保险公司和其他单位不 得强制他人订立保险合同。 5n第四条 从
