1、摘 要I摘 要专利权是知识经济时代最重要的产权，在现代社会中具有举足轻重的作用。专利权制度赋予权利人一定时期合法的垄断，权利人为谋求利益的最大化，就有可能滥用该制度 ，从而使得专利权制度存在的价值被削弱。因此，有必要在相关法律中平衡专利权的保护与其正确行使。专利权滥用的规制问题也就成为近年来专利权理论研究领域的一个重要课题。我国关于专利滥用的研究尚不成熟且缺乏统一的法律体系，各种国外学说和司法实践模式纷纷被介绍到中国，需要进行宏观的梳理以形成一个清晰的理论框架。笔者想借此研究之机，对专利权滥用规制的理论进行系统深入的学习；在借鉴国外做法的同时，必须了解我国相关理论看待和处理专利权滥用的基本观点
2、。在此过程中，笔者希望通过对专利权滥用规制理论的介绍及结合相关案例进行的比较分析。笔者认为，专利权滥用规制的引进必然会对我国传统的法律体系带来冲击和挑战，因此我们更应该在专利权运用问题上投注精力。本文主要探讨专利滥用的界定和比较各国的反垄断规制模式，从而对我国引入相关制度提出可行性建议。 （1）对专利权与反垄断法的关系作出解释，这让读者对专利制度有一个深入的了解 ，否则可能会对 这种合法垄断的在产生存在的质疑；（ 2）在充分了解专利滥用理论的基础上，提炼自己的观点 ，对什么是专利滥用 概念作出界定 并通过对有名的案例进行分析，给读者以更加深刻的了解和印象 ；（3）各国对专利滥用 反垄断法规制的
3、立法与司法实践 ；（4）反思我国国内的立法现状及对立法构建提出预期和展望。关关键键词词：专利滥用 反垄断 比较分析AbstractIIAbstractAmong Intellectual Properties the role Patent plays cannot be overemphasized. Patent guarantees that patentees monopolize his or her patent, which implies a negative possibility of patent-abuse. Therefore, such patent abuse s
4、hould be controlled by devising a set of legal mechanism. It is this dimension that has produced hot discussions in patent law context. Research on patent abuse in China has not been ripe. At the present, legal mechanism concerned with patent abuse in other jurisdictions has been introduced in China

Therefore, in addition to try to have a good command of domestic legal rules and theories concerned with patent abuse, I need to do research on cases and rules in foreign jurisdictions to form a clear picture of how to make sound factual and legal judgments on patent abuse matters. This article di
6、scusses patent abuse through a comparative method, paying more attention to controlling patent abuse the legal rules of which in other jurisdictions are being transplanted in China. This article discusses four issues. Part I explains the relationship between anti-trust law and patent law. Part II ar
7、gues the exact concept of “patent abuse” with several well-known cases. Part III introduces legal mechanism in several countries and jurisdictions. Part IV puts forward the future picture of domestic legal mechanism after reviewing the present domestic legal mechanism in patent abuse domain.Key word
