1、上海交通大学 MPA 学位论文 上海镇村治理关系及其优化研究 I上海镇村治理关系及其优化研究 以上海市 A 镇为例 摘 要 20 世纪 80 年代以来，我国农村基层管理体制和治理方式发生了深刻的变化， 在基层农村管理体制中并存着两个处于不同层面且相对独立的权力载体：一是代表国家自上而下行使行政管理权的乡镇政府，二是代表村民行使基层社区自治权的村民委员会。按照村民委员会组织法的制度安排，乡镇是国家的基层政权，依法行政，村民委员会是村民自治组织，依法自治。然而自“镇村分治”以来，事实上对于乡镇政府与村民委员会之间究竟是“指导关系”还是“领导关系”的界定并不清楚，镇村治理关系在现实问题上的调处往往与
2、政策规定的不一致，或存在许多的矛盾和困难。 本文对我国自民国时期起至今的镇村治理关系的历史演变历程进行了回顾，并对目前我国镇村的法定关系进行了探究，比较分析了镇村治理关系和政企关系、 镇居关系的相似处及不同点。 在此基础上，进一步对特定的对象上海市 A 镇进行了调查研究， 通过问卷调查的方式分镇干部、 村干部、 村民三个层次对镇村治理关系的认知程度、镇村治理关系的表现形式等多个方面进行了定性分析， 展现出 A 镇镇村治理关系的现状,并通过对 A 镇镇村治理关系中隐含的主要问题进行分析，找出了以下四个主要问题：一是镇村治理关系超越了“指导与被指导”关系；二是镇与村的职责不清；三是镇村两级的关注点
3、不再完全一致；四是村干部的实际能力与现实要求存在差距。 根据以上分析， 本文从五个方面提出了改善镇村治理关系的基本思路和对策：1、理清职能，找准位置，正确发展镇村治理关系；2、正确履行村级组织职能，实现村民自治；3、加强法制宣传，提高村民自我管理的意识；4、提高素质，加强村镇人才培养；5、完善政府配套服务，实现政府职能的社会化。 关键词：上海，乡镇政府，村委会，治理，关系 上海交通大学 MPA 学位论文 上海镇村治理关系及其优化研究 IIRESEARCH ON THE RELATIONSHIP AND OPTIMIZATION BETWEEN TOWN GOVERNMENT AND VILLA

These are two vehicles of power not only in different aspects but also relatively independent. According to the Organic Law of the Villagers Committees of the Peoples Republic of China, the people
6、s government of a township or a town is the primary administration authority which exercises its right in accordance with law. Meanwhile, the villagers committee is the primary mass organization of self-government which exercises its political right in accordance with law. However, we still not unde
7、rstand the relationship between the government of a township or a town and the villagers committee since they are governed separately. Do they guide or lead with each other? The solution is not frequently accordance with the policies, and whats more, there are great contradiction and difficulties in

On this basis, this paper investigates a special A town in shanghai. Through a s
10、ampled questionnaire survey toward cadres of town, cadres of village and villagers, it provides a qualitatively analysis from many aspects such as understanding of the relationship between a town and a village and a representation of it, which presents the current situation and existing problems. 16、实问题上的调处往往与政策规定的不一致，或存在许多的矛盾和困难，两种权力的运作界限不明，关系不规范，制约了乡镇政府行政职能的发挥以及村民自治的健康发展， 对农村基层稳定造成了一些不利的影响。本文拟通过对特定的对象上海市 A 镇进行调查研究，针对镇村治理关系存在的问题及如何优化提出一些合理化建议，以促进农村治理结构的不断完善。 第一节 选题的目的和意义 1982 年， 我国在 宪法 中明确 “村民委员会是基层群众性自治组织” 。 1986年 6 月开始，村民自治在全国各地得到普遍推行，标志着国家权力在乡村社会的退出和乡村社会民主化的开始， 乡镇政府演化为我国政府序列中最基层的政权组织。1998 年，全国人大在经过十年左
