1、中南民族大学硕士学位论文 I摘 要 行政信访制度是一项具有中国特色的制度。它是人民群众依法行使民主权利，管理国家、经济、文化、社会事务和维护自身合法权益的重要形式。在我国改革开放不断深入、经济社会加速转型以及社会利益格局调整的大环境下，各种矛盾日益凸显出来，而我国目前的行政信访制度在有效地化解这些矛盾，促进和谐社会的构建等方面发挥了重要的作用。 本文试对行政信访制度的基本理论和现状进行介绍，通过对其缺陷的分析提出健全和完善行政信访制度的相关措施。 全文包括引言、正文和结语三个部分，文章的基本结构如下: 引言部分着重介绍了笔者对我国行政信访制度的认识和选题的缘由。 正文部分包括四章内容，每章的内
2、容具体介绍如下: 第一章是对我国行政信访制度的概述。在该章，对选题的相关概念进行了较为详细的解读；回顾了我国行政信访制度的发展沿革；深入地阐述了行政信访制度的主要功能。 第二章是对我国行政信访制度现状及存在的主要问题的分析。在该章，结合2005 年 5 月 1 日起施行新修订的信访条例 ，对我国现行的行政信访基本制度进行了规范性分析； 通过调研掌握的鹤峰县行政信访的相关材料分析了该县行政信访的状况， 并以鹤峰县的行政信访为焦点透视了我国行政信访制度存在的相关问题。 第三章是对国外类似我国行政信访制度及启示的说明。在该章，对类似我国行政信访制度的瑞典、日本和韩国等国的相关制度进行了介绍，并从中总
3、结了可供我国借鉴的经验。 第四章是对我国行政信访制度的改革和完善的思考。在该章，主要从强化行政信访机构的独立性和权威性、 在行政信访机构的内部建立人大代表信访监督专员制度、建立律师参与行政信访工作的长效机制、在行政信访工作中构建听证制度、 在行政信访工作中构建新闻舆论监督制度和坚定不移地推进司法体制改革等方面进行阐述。 结语部分是对本文的小结， 同时对我国行政信访制度的发展前景作出了预测: 行政信访制度的完善，并非朝夕就能完成，是一个渐进的过程。我们坚信，在党中南民族大学硕士学位论文 II中央和国务院的英明领导和决策下，在广大专家和学者的共同探究下，行政信访制度一定能够摆脱困境， 走上法治化的

It is such an important form that people can exercise their democratic rights, manage their national, economic, cultural, social affairs and safe

Under the environment of deepening of reform and opening up, accelerating transformation of the economy and society and the structural adjustment of social interests, various contradictions emerged. However, Chinas administrative system for letters and ca
6、lls has played an important role in resolving these contradictions and promoting harmonious society effectively. This paper tries to introduce the basic theory and the current situation on administrative system for letters and calls, then puts forward related measures on how to improve and perfect a
7、dministrative system for letters and calls by analyzing its flaws. This paper includes three parts as introduction, body and conclusion. Its basic framework is as the followings. The first part mainly introduces the authors understanding of administrative system for letters and calls and the reasons
8、 why the topics were selected. The body part includes four chapters. The first chapter is an overview on Chinas administrative system for letters and calls. The related concepts on the topics are interpreted in details. The development history of Chinas administrative system for letters and calls is
9、 reviewed. The main functions of the administrative system for letters and calls are expounded deeply . The second chapter includes the analysis of the status and the main problems of Chinas administrative system for letters and calls. Combined with the new amendments Letters and Calls Regulations o
10、n May 1, 2005, Chinas present administrative system for letters and calls is analyzed normatively. Hefeng Countys present status of administrative for letters and calls is analyzed through the relevant materials from this county and the existing problems of Chinas administrative system for letters a
11、nd calls are analyzed through the focus of Hefeng Countys administrative for letters and calls. 中南民族大学硕士学位论文 IVThe third chapter is the illustration of foreign countries administrative for letters and calls which is similar to Chinas and its enlightenments. This chapter mainly introduces relative sy
12、stem of Sweden, Japan and South Korea and sums up some experience which can be used for reference in China. The fourth chapter is the thinking on the reform and improvement of Chinas administrative system for letters and calls. This chapter mainly expounds through strengthening the independence and
13、authority of the administrative institutions for letters and calls, establishing the system of specific supervisors from the members of the Peoples Congress within the administrative institutions at all levels, establishing the long-term mechanism which lawyers can be involved in the activities of a
14、dministrative system for letters and calls, as well as hearing system and news media supervision system, and promoting the reform of judicial system. The conclusion part is the summary of this article. The future development of Chinas administrative system for letters and calls is predicted. The per
15、fection of Chinas administrative system for letters and calls is not easy and is a gradual process. We firmly believe that under the wise leadership and decision-making of the CPC Central Committee and State Council, under the research of experts and scholars, the administrative system for letters a
16、nd calls can solve these problems and take to the track of rule of law, and it can make positive contributions for the construction of harmonious society.
