3、用上述授权。)声明人(签名)：f奇艳艺Df中年牛月，日内容摘要未成年人一直是社会各界普遍关注的群体之一，他们代表着一个民族 的希望和未来。未成年人由于年龄原因身心尚未成熟，其权利的实现只能 借助于其他主体，而监护制度的设计正是未成年人这一需求的法律应对。 近年来，随着跨国婚姻家庭关系的日趋复杂，未成年人的监护权争夺变得 愈发尖锐而敏感。然而各国实体法律中有关未成年人监护的规定存在着诸 多差异，适用不同的法律来调整此法律关系，可能会产生截然不同的判决 结果。因此，研究未成年人监护的法律适用具有理论与实践上的双重意义。2011年4月1日生效的涉外民事关系法律适用法中结束了我国长 期以来缺乏涉外监护
4、法律适用立法的历史。其第30条规定吸收了国外立法 的先进经验，弥补了监护法律适用上的空白，体现了弱者权利的保护，增强了法律选择的灵活性。但该规定也存在不足，需立法及司法实践加以改 进克服。除前言外，本文一共三章。第一章是未成年人监护法律适用概述，介 绍了监护法律适用的理论与立法模式与，以及我国在监护法律适用上的立 法沿革；第二章是本文的重点，我国目前涉外监护法律适用的规定，评析 了第30条的特点与不足：第三章针对第二章中的提到的不足，分别从范围、系属和法律选择方法上提出了建议，希望能在法律适用上层面上最大限度 保障未成年人的权益。关键词：未成年人监护：法律适用；弱者保护ABSTRACTMino
