5、sions第六章 附 则Chapter I General Provisions第一章 总 则Article 1 For the purposes of protecting the copyright of authors of literary, artistic and scientific works and their copyright-related rights, encouraging the creation and dissemination of works which facilitate the advanced socialist culture, ideolog
6、y and material construction and promoting the development and flourish of the socialist culture and science, and in accordance with the Constitution, this Law is formulated.第一条 为保护文学、艺术和科学作品 作者的著作权，以及与著作权有关的权益， 鼓励有益于社会主义精神文明、物质文明建 设的作品的创作和传播，促进社会主义文化 和科学事业的发展与繁荣，根据宪法制定本 法。Article 2 Works of citizens
7、, legal persons or other organizations of China shall enjoy copyright according to this Law, whether or not they are published or unpublished.第二条 中国公民、法人或者其他组织 的作品，不论是否发表，依照本法享有著作 权。Copyright enjoyed by works of foreigners and stateless persons according to the agreements signed by China and the Sta
8、tes of which the authors are nationals or in which the authors domicile habitually or the international conventions to which both China and the States are members shall be protected by this Law.外国人、无国籍人的作品根据其作者所 属国或者经常居住地国同中国签订的协议或 者共同参加的国际条约享有的著作权，受本 法保护。Works of foreigners and stateless persons sh
9、all enjoy copyright according to this Law, if they are first published in the territory of China.外国人、无国籍人的作品首先在中国境 内出版的，依照本法享有著作权。Works of authors of the States which have not signed the agreements with China or have not joined the international conventions to which China is the member and works of
10、stateless persons shall be protected by this Law, if they are first published in the Member States of the international conventions to which China is the member or are simultaneously published in the Member and Non-member States.未与中国签订协议或者共同参加国际条 约的国家的作者以及无国籍人的作品首次在 中国参加的国际条约的成员国出版的，或者 在成员国和非成员国同时出版
11、的，受本法保 护。Article 3 Works, as used in this Law, shall include such works as literature, art, natural science, social science and engineering technology created in the following forms:第三条 本法所称的作品，包括以下列 形式创作的文学、艺术和自然科学、社会科 学、工程技术等作品：1. Writings works; (一)文字作品；2. Oral works; (二)口述作品；3. Music, dramatic,
12、quyi, dance and acrobatic works;(三)音乐、戏剧、曲艺、舞蹈、杂技艺 术作品；4. Painting and architectural works; (四)美术、建筑作品；5. Photographic works; (五)摄影作品；6. Cinematographic works and works created by virtue of the analogous method of film production;(六)电影作品和以类似摄制电影的方法 创作的作品；7. Graphic works such as diagrams of project
13、design, drawings of product design, maps and sketches as well as works of their model;(七)工程设计图、产品设计图、地图、 示意图等图形作品和模型作品；8. Computer software; and (八)计算机软件；9. Other works set out by laws and administrative regulations.(九)法律、行政法规规定的其他作品。Article 4 Works of which publication and dissemination are prohibi
14、ted according to law shall not enjoy the protection under this Law.第四条 依法禁止出版、传播的作品， 不受本法保护。In exercising copyright, no copyright owner may violate the Constitution and laws and infringe the public interests.著作权人行使著作权，不得违反宪法和 法律，不得损害公共利益。Article 5 This Law does not apply to: 第五条 本法不适用于：1. Laws, regu
15、lations, resolutions, decisions and decrees of state authorities and other documents of legislative, administrative or (一)法律、法规，国家机关的决议、决 定、命令和其他具有立法、行政、司法性质judicial nature, as well as their official translations;的文件，及其官方正式译文；2. News on current events; and (二)时事新闻；3. Calendar, numerical tables, gene
