1、浅谈商务英语合同翻译以古体词的应用为例摘要：由于商务合同的特殊功能，商务合同在词汇方面有独特的特征，如专业性、简洁性和用词正式等。古体词是一种典型的合同用语，在商务合同中正确使用古体词能让语言显得严肃、准确和简洁。准确理解商务合同中的古体词对分析和翻译商务合同是非常关键的，相应地，准确翻译英语商务合同是经济活动顺利进行的关键。关键词：商务合同；古体词；英汉翻译Abstract: Due to the special features of business contract, business contracts have unique characteristics in vocabular

3、is and translation of business contract, accordingly, accurate translation of English business contract is the key to smooth economic activities.Key words: business contract; archaic words; English-Chinese translation中国自2001年12月11日加入世界贸易组织已有11年，在此期间，中国有步骤地扩大商品和服务贸易领域的对外开放,在对外经济贸易中日趋活跃。英语作为国际通用语言，已成为
4、世界经济活动中必不可少的语言沟通工具，特别是在商务合同的签订上。在对外贸易得以成功的诸多要素中，商务合同所起的作用不可或缺。然而我国商务合同英语翻译的现状令人担忧。该领域的研究状况也不尽人意,一方面对商务合同翻译方面的科学研究目前还比较分散,另一方面也较少有人涉足适合商务合同翻译独特规律的探讨。商务合同涉及众多行业,贯穿经贸业务的诸多环节,种类繁多、程式各异,其语言特点和行文程式丰富多变,它独特的功用、多样化的文体特色和复杂的内涵,本该得到深入的探究。商贸领域是一块值得深入探讨的新领域因此，笔者将以古体词的应用为例对商务英语合同翻译进行分析研究。一古语指示词概述及常见情形。（一）古语指示词概述
5、商务英语合同具有类法律性。某种意义上,一份合同就是一部约束缔约方的小法律。在语言的使用方面, 合同往往会遵循法律语言的庄严性、正式性, 因此, 立法文本中的古语指示词自然地迁移到了商务英语合同中。商务合同英语所追求的目标不是语言的艺术美，而是逻辑的精确性与严谨性、表述的专业性与规范性以及思维的清晰性和条理性。书卷词语、专业术语、古体词、外来词、词语并列以及模糊限制词等在商务合同英语中的使用充分体现了商务合同英语在词汇层面上所具有的文体特征。商务合同英语具有古体特点，这种古体特点的一个主要标志是古体词语的使用。古体词(archaic words)是一种具有鲜明文体色彩的词汇成分。尽管古体词在现代
6、英语口语和一般书面语中极少使用，但在商务合同等法律文体中，古体词却大量出现，充分体现出其庄重严肃的文体风格，这除了与商务合同英语文体的社会职能密不可分以外，也表明为了显示本行业的特殊性，工商及法律界人士对其有特殊的情结。古旧指示词是指一些过时的词语, 用以指向自身文本的其他部分, 或指向其他地方或时间。商务合同英语中最常使用的古体词多为一些复合副词，即由here，there 和where 分别加上after，at，by，from，in，of，to，under，upon，with 等一个或几个介词共同构成的复合副词。主要包括hereby, hereof, herein, hereto, here
7、after; thereby, thereof, therein, thereto, thereunder, thereafter; whereby, whereas, wherein 等。古语指示词属于法律语言中古旧词汇的一类, 普通文体中很少使用, 但在类法律的合同文本中这类古旧词的使用非常普遍。对于这类合成词属性的界定存在较大的差异, 英汉词典一般将其列为副词, 学界有人将其称为复合副词。本文沿用古语指示词这一概念主要是基于它们在合同中的语用功能的考虑。（二）常见的古语指示词1.以here为前缀的古体词在商务合同中，here代表this，指本文件(法律，合同，条约等)，例如：hereaf
