5、dominantpositionintheinternationaltradeastheconvenientcondition,andmaketheinternationaltraderulewhichismoreadvantageoustothem. GATTtwentieth(b)allowsmemberstotakemeasurestoprotectthelivesandhealthofhumanbeings,animalsandplants,whichisaninternationalfoodtradepersonwhocantakenontariffmeasurestoprotect
6、theinterestsofthestakeholders.Inthemultilateralnegotiations,thetwomajoragreementsrelatedtofoodsafety,thetechnicalbarrierstotradeagreement(TBTagreement)andtheagreementontheimplementationofsanitaryandphytosanitarymeasures(SPSagreement)werereached.Thesetwoagreementsmakemorespecificprovisionsonthelifeof
7、animalsandplants,andtakethenecessarymeasurestorestricttrade,andalsotakemeasurestomaketheprovisionsbinding.UndertheframeworkofWTO,thetradeagreementsledbydevelopedcountrieshaveprovidedlegalsupportfortheprotectionofdomesticsimilarfoodindustryandtheestablishmentoftradebarriers.Moreover,developedcountrie
8、scanadjusttheirtradebarriersaccordingtotheirownindustrialdevelopmentandoverallfoodtrade,soastosafeguardnationalinterests.3 (2)lackofsupervisiononfoodsafetyinChina Chinasfoodsupervisionmainlyreferstotheregulatoryaspectsofthetechnicallevelandinternationalstandardstandards,suchasinspectionandQuarantine
9、offoodexportsisnotperfect,thetechnicallevelisnotuptotheinternationalstandard,thedetectionofmanytoxicandharmfulsubstancesandthedifferencebetweentheforeigncountries,thesamedetectionprocessofharmfulsubstancesisplicatedandexpensivecost.Manyspecialfoodsafetyregulatoryagenciesuseafullrangeofimportedequipm
10、ent,ignoringtheindependentRD,excessiverelianceonforeigntechnology. TheinvestigationshowsthatmanycountriesabusetheirpowerandmakeexcusestotakestrictinspectionandrestrictivemeasuresonChinasexportoffoodandagriculturalproducts.Andthesecountrieshaveexpandedthescopeoftestingrestrictionsontheirexportsoffood
11、,andinthefaceofdifferentcircumstances,thesecountrieswillalsotakecorrespondingchangesandupgrademeans. (three)lackoffoodsafetyriskassessmentmechanism TheStateQualityInspectionAdministrationonXXtheimplementationofexitinspectionandquarantineriskearlywarningandrapidresponsemanagementregulations,althought
12、heprovisionsmentionedintheriskassessmentandriskwarningmechanisminSPSprotocol,buttheimplementationneedstobeimproved.Althoughthefoodsafetylawisbasedontheprincipleofriskassessmentmechanism,thesupportingmeasuresarenotstrong,andlackofcorrespondingmonitoringsystem,analysissystemandothersupportingsystems.
13、Inaddition,paredwithotherdevelopedcountries,thecountrysfoodinnovationcapacityisweak,andnewresearchpointsneedtobedeveloped.Becausethecurrentriskassessmentsystemcannotbeinlinewithinternationalstandards,itisdifficulttoaccuratelyassesstheriskoffoodsafety. Two.Legaladviceonfoodsafetyininternationaltrade
14、(1)effortsshouldbemadetobuildearlywarningandcountermeasuresagainsttradebarriersinfoodtrade Mostofthetradebarriersininternationaltradearemadeupofgreenbarriers.Therefore,itisveryimportanttoestablishandperfectthegreenbarrierearlywarningandcountermeasuresmechanism. Includingtherealconcernofforeignfoodsa
15、fetyindustryresearchtrends,acceleratethetransmissionofinformationwithinthefoodindustry,thecollectionofvaluableinformation,studyabroadgreenbarriersspecifictrendsrespondquicklytotheimpactoftechnicalbarrierstoChinasexportsofagriculturalproducts,theformationofearlywarningmechanism,towintheinitiative.The
16、concretecountermeasuresmainlydealwiththeunreasonableinternationaltradebarriersthroughthedisputesettlementmechanismundertheWTOframework.
