1、解除劳动合同协议书英文版 劳动合同的解除和终止中英文对照 劳动合同的解除和终止 RescissionandTerminationofLaborContract 第十八条有下列情形之一的依照劳动合同法规定的条件、程序劳动者可以与用人单位解除固定期限劳动合同、无固定期限劳动合同或者以完成一定工作任务为期限的劳动合同： Article18SubjecttotheconditionsandproceduressetforthintheLaborContractLaw,anemployeemayrescindthelaborcontracthavingafixedterm,nonfixedtermort
2、ermsubjecttothepletionofcertaintaskthatsuchemployeehasexecutedwiththeemployer,ifanyofthefollowingeventsoccurs: (一)劳动者与用人单位协商一致的; (1)theemployeeandtheemployerhavemutuallyagreedthereonthroughnegotiation; (二)劳动者提前30日以书面形式通知用人单位的; (2)theemployeehasnotifiedtheemployerthereofinwriting30daysinadvance; (三)劳
3、动者在试用期内提前3日通知用人单位的; (3)theemployeehasnotifiedtheemployerthereofinwriting3daysinadvanceduringtheprobationaryperiod; (四)用人单位未按照劳动合同约定提供劳动保护或者劳动条件的; (4)theemployerhasfailedtoprovidethelaborprotectionorworkconditionasagreedinthelaborcontract; (五)用人单位未及时足额支付劳动报酬的; (5)theemployerhasfailedtopaytheworkremun
4、erationfullyandtimely; (六)用人单位未依法为劳动者缴纳社会保险费的; (6)theemployerhasfailedtopaythesocialinsurancepremiumonbehalfoftheemployeesasrequiredbythelaw; (七)用人单位的规章制度违反法律、法规的规定损害劳动者权益的; (7)theemployersbylawsandrulesviolatelawsandregulationsandimpairtherightsandinterestsoftheemployee; (八)用人单位以欺诈、胁迫的手段或者乘人之危使劳动者在
5、违背意思的情况下订立或者变更劳动合同的; (8)theemployeradoptsfraudulentorthreateningmeansortakesadvantageoftheemployeebeingindistresstoforcetheemployeetosignorrevisethelaborcontractincontrarytotherealintentionoftheemployee; (九)用人单位在劳动合同中免除自己的法定责任、排除劳动者权利的; (9)theemployerexemptsitselffromthestatutoryobligationsandexclud
6、estherightsoftheemployeeinthelaborcontract; (十)用人单位违反法律、行政法规强制性规定的; (10)theemployerisinviolationofthestatutoryprovisionsoflawsandregulations; (十一)用人单位以暴力、威胁或者非法限制人身自由的手段强迫劳动者劳动的; (11)theemployerhasforcedtheemployeetoworkbymeansofviolence,threateningorillegallimitationofthepersonalfreedom; (十二)用人单位违章
7、指挥、强令冒险作业危及劳动者人身安全的; (12)theemployerhasinpliantlydirectedorforcefullyorderedtheemployeetoworkunderdangers,endangeringthepersonalsafetyoftheemployee;or (十三)法律、行政法规规定劳动者可以解除劳动合同的其他情形 (13)anyothereventwheretheemployeemayrescindthelaborcontractunderlawsandregulations. 第十九条有下列情形之一的依照劳动合同法规定的条件、程序用人单位可以与劳
8、动者解除固定期限劳动合同、无固定期限劳动合同或者以完成一定工作任务为期限的劳动合同： Article19Anemployermayrescinditslaborcontractwithafixedterm,nonfixedtermortermsubjecttopletionofcertaintasksignedwithanemployeeaccordingtotheconditionsandproceduressetforthintheLaborContractLaw,if: (一)用人单位与劳动者协商一致的; (1)theemployerandtheemployeereachanagreem
9、entthroughnegotiation; (二)劳动者在试用期间被证明不符合录用条件的; (2)theemployeeprovestobedisqualifiedforrecruitmentduringprobationaryperiod; (三)劳动者严重违反用人单位的规章制度的; (3)theemployeemateriallyviolatesthebylawsandrulesoftheemployer; (四)劳动者严重失职营私舞弊给用人单位造成重大损害的; (4)theemployeeisingrossnegligenceandmalpractice,whichcausesmate
10、rialdamagestotheemployer; (五)劳动者同时与其他用人单位建立劳动关系对完成本单位的工作任务造成严重影响或者经用人单位提出拒不改正的; (5)theemployeeestablishesemploymentrelationwithanyotheremployerconcurrently,whichmateriallyimpedesthepletionoftasksatthecurrentemployerorfailstoberectifiedafterthenotificationbythecurrentemployer; (六)劳动者以欺诈、胁迫的手段或者乘人之危使用
11、人单位在违背意思的情况下订立或者变更劳动合同的; (6)theemployeeadoptsfraudulentorthreateningmeansortakesadvantageoftheemployerbeingindistresstocausethelaborcontracttobeexecutedorrevisedincontrarytotherealintentionoftheemployer; (tobecontinued) 解除劳动合同协议 企业名称(甲方)：职工姓名(乙方)： 甲乙双方于年11月28日订立了为期3年的劳动合同现经乙方提出并双方协商一致同意解除劳动合同,并达成如下协

14、tiesshallproceedwithworkhandoveraccordinglyinlinewithpanyspolicies; 2、PartyAagreetopayPartyBalumpsumofRMB7000aspensation forterminationofthelaborcontract; 3、Uponterminatingthelaborcontract,eitherofthepartiesshallnotmake orthreatentomakeanyclaimsortakelaborarbitrationorlitigationagainsttheotherparty; 4、Thisagreementshalleintoeffectuponsigningbybothparties;5、Thisagreementismadeintwooriginals,andeachpartyholdsoneof these.Thetwooriginalshavethesamelegaleffect; 6、ThisagreementismadeinbothChineseandEnglish.Ifthereisany discrepancybetweentheEnglishandChineseversion,theChineseversionshallprevail;
