2、ei UniversityDate of Oral Examination : December，2011摘 要摘要自新中国成立后，妇女从家庭逐步走向社会，大规模地参与到社会生产劳动中， 妇女参与社会劳动的比率逐年增长，社会地位也不断提升。但是由于传统观念和主客观条件的影响，妇女就业中劳动权益屡屡受侵，已是一个普遍现象，而我国现行立法并不能对妇女劳动权益提供全面的保护，也未能提供适当而统一便捷的救济方法。妇女劳动权利的保障还没有达到预期的效果。劳动权益是一项宪法性权利，关系到女性生存和发展的根本问题。因此，本文针对侵犯妇女劳动权益的历史根源、社会现状及其目前的立法存在的问题进行分析，从社会性别
3、角度出发，重新审视妇女的劳动权益相关立法及其现实问题，并提出完善妇女劳动权益保障的立法构想和解决途径，从而在制度和立法上对妇女劳动权益给予充分保障，寻求为妇女生存、发展提供平等的环境和条件。对本课题的研究主要通过理论分析来进行。论文将参考国内外相关研究成果，对我国新时期妇女劳动权益的现状及特点，妇女劳动权益受侵害的原因，我国立法在妇女维权方面的局限性及缺陷进行探析，从而提出我国妇女维权法律制度的设计构想，逐步展开论述。首先，从研究角度上，注重从人权的层面，宪法角度来看待和探讨妇女维权的法律问题，论证其重要意义，及设立相关法律制度的构想。其次，改革诉讼制度。借鉴国外公益诉讼的相关规定，设置劳动法
4、庭和建立公益诉讼制度。加强法律条文的可诉性，成立专门处理妇女权益争议的机构，设立独立的妇女权益保障争议诉讼程序，使妇女权益受到侵犯时能够进入普通诉讼程序。采取举证责任转移，原告只需初步证明其劳动权益遭受侵害。通过审判制度的改革保证妇女劳动权益得到保护。第三，女性劳动权益受到的最普遍侵害即性别歧视，我国立法有必要将其法律化制度化，以更好地保护劳动者的平等就业权。关键词 妇女劳动权益社会性别 就业歧视 源头化维权IAbstractAbstractWomens liberation by womens release from the barriers of family, entering soc
