1、沈阳师范大学硕士学位论文我国公众参与立法的制度保障研究姓名：迟雪妍申请学位级别：硕士专业：政治学理论指导教师：高燕宁20100501我国公众参与立法的制度保障研究中文摘要随着社会的日益发展, 党的十六大明确提出: 要“扩大公民有序的政治参与”, “完善公开办事制度”, 以及完善决策机制, “推进决策科学化民主化”,“建立社情民意反映制度, 建立与群众利益密切相关的重大事项社会公示制度和社会听证制度”。自从新中国建国以来公众直接参与立法的方式在新中国的立法实践中一直在摸索当中。政治和法律都是保障我国现代化国家发展的必要因素，政治文明包括了政治思想文明、政治制度文明、政治行为文明、政治观念文明、政
2、治体制文明等。社会主义政治文明建设的核心, 在于实现社会主义民主政治的制度化、规范化、程序化, 通过制度安排和制度创新来保证人民充分行使民主选举、民主决策、民主管理、民主监督的权利。因此, 社会主义政治文明与社会主义法治国家建设具有相同的价值指向。依法治国所依之法, 首先必须充分尊重和反映最广大人民群众的利益和宪法权利, 广大的人民群众的利益和意志，必须在立法过程中得到表达和关注, 并经过必要且合法的程序, 最终在法律中得到体现。也就是说, 政治文明所要求的法治内在地要求实现民主政治, 法必须具有所谓“ 良法”之属性。社会主义政治文明建设, 既为新时期推进立法的公众参与提供了良好的社会的政治条
3、件, 同时,也对公众参与的能力、参与的制度化水平提出了更高的要求。我国加入世界贸易组织, 对推进立法的公众参与则直接起了“ 外力驱动”的作用。在建设社会主义政治文明的同时, 我们要以更广阔的视野和胸襟, 拓展公众立法参与的广度和深度, 推进公众参与立法的进一步制度化、程序化。新时期进一步推进立法的公众参与, 尚有许多问题值得我们深入研究, 这里既有观念、文化层面的问题, 也有制度、体制层面的问题。其中, 立法公众参与的进一步制度化问题、制度创新的世界眼光以及公众参与能力的培养等问题值得我们深人加以关注。党的“ 十六大”进一步强调必须扩大公民有序的政治参与, 同时强调要加强立法工作, 提高立法质
4、量, 形成中国特色社会主义法律体系。党的十七大又提出“坚定不移发展社会主义民主政治”，而公众参与立法则是提高立法质量的基本前提。我们必须直面“ 人世”对我国立法观念和立法制度带来的影响, 进一步扩大公民有序的政治参与, 推进公众参与立法的制度创新， 提高公众参与立法的能力, 加强公众参与立法的制度保障，从而全面推进社会主义政治文明建设。关键词：政治文明，公众参与，制度保障Chinas participation in the legislative systemto protect the public researchAbstractAs society evolves, the party
