1、1/1/82INSTITUTE CARGO CLAUSES (A)RISKS COVERED1. This in sura nee covers all risks of loss of or damage to the subject-matter in sured except as provided in Clauses 4, 5, 6 and 7 below.2. This in sura nee covers gen eral average and salvage charges, adjusted or determ ined accord ing to the con trac
2、t of affreightme nt an d/or the gover ning law and practice, in curred to avoid or in conn ecti on withthe avoida nee of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 or elsewhere in thisin sura nee.3. This in sura nee is exte nded to indemnify the Assured aga inst such proporti
3、 on of liability un der the con tract of affreightment Both to Blame Collision Clause as is in respect of a loss recoverable hereunder. In the eve nt of any claim by shipow ners un der the said Clause the Assured agree to no tify the Un derwriters who shall have the right, at their own cost and expe
4、 nse, to defe nd the Assured aga inst such claim.EXCLUSIONS4. In no case shall this in sura nee cover4.1 loss damage or expe nse attributable to wilful misc on duct of the Assured4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matterin sured4.3 loss
5、damage or expe nse caused by in sufficie ncy or un suitability of pack ing or preparati on of thesubject-matter in sured (for the purpose of this Clause 4.3 pack ing shall be deemed to in elude stowage in a container or liftvan but only when such stowage is carried out prior to attachment of this in
6、 sura nee or by the Assured or their serva nts)4.4 loss damage or expe nse caused by in here nt vice or n ature of the subject-matter in sured4.5 loss damage or expe nse proximately caused by delay, eve n though the delay be caused by a riskin sured aga inst (except expe nses payable un der Clause 2
7、 above)4.6 loss damage or expe nse aris ing from in solve ncy or finan cial default of the owners man agerscharterers or operators of the vessel4.7 loss damage or expense arising from the use of any weapon of war employing atomic or nuclearfission and/or fusion or other like reaction or radioactive
8、force or matter.第1页共5页5. 5.1 In no case shall this in sura nee cover loss damage or expe nse aris ing fromun seaworthi ness of vessel or craft,unfitn ess of vessel craft conv eya nee container or liftva n for the safe carriage of the subjectmatter in sured,where the Assured or their serva nts are pr
9、ivy to such un seaworthi ness or unfitn ess, at the time the subject-matter in sured is loaded therei n.5.2 The Un derwriters waive any breach of the implied warra nties of seaworthi ness of the ship and fitn ess of the ship to carry the subject-matter insured to destination, unless the Assured or t
10、heir servants are privy to such un seaworthi ness or unfitn ess.6. In no case shall this in sura nee cover loss damage or expe nse caused by6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act byor aga inst a belligere nt power6.2 capture seizure
11、 arrest restra int or deta inment (piracy excepted), and the con seque nces thereof or anyattempt thereat6.3 derelict mi nes torpedoes bombs or other derelict weap ons of war.7. In no case shall this in sura nee cover loss damage or expe nse7.1 caused by strikers, locked-out workmen, or persons taki
12、ng part in labour disturbances, riots or civilcommotio ns7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions7.3 caused by any terrorist or any pers on act ing from a political motive.DURATION8. 8.1This in sura nee attaches from the time the goods leave the warehouse
13、 or place of storage at theplace n amed here in for thecomme neeme nt of the tran sit, continues dur ing theordinary course of tran sit and termi nates either8.1.1 on delivery to the Con sig nees or other final warehouse or place of storage at the dest in ati onn amed here in,8.1.2 on delivery to an
14、y other warehouse or place of storage, whether prior to or at the desti nati onnamed herein, which the Assured elect to use either8.1.2.1 for storage other tha n in the ord inary course of tran sit or8.1.2.2 for allocati on or distributio n,or第2页共5页8.1.3 on the expiry of 60 days after completio n of
15、 discharge overside of the goods hereby in suredfrom the oversea vessel at the final port of discharge,whichever shall first occur.8.2 If, after discharge overside from the oversea vessel at the final port of discharge, but prior toterm in ati on of this in sura nee, the goods are to be forwarded to
