2、影视剧本的著作权保护 以警中警著作权纠纷案为视角内容摘要保护影视剧本著作权对促进影视产业发展,推动文化的传播起着积极的作用。然而,我国著作权立法中对剧本著作权保护的规定并不明确。剧本剽窃、新类型剧本署名权纠纷、剧本作者对影视作品的后续利用是否享有权益等是影视剧本著作权纠纷司法实践中常出现的问题,而纵观我国立法,对此类问题并未作出进一步规定。为此,有必要对影视剧本著作权保护进行研究,利于此类案件的处理。本文从案例出发,通过对实务中出现的重点问题进行阐述,就我国影视剧本著作权立法存在的不足进行探讨,提出司法实践中此类案件的处理对策。除引言外,本文分为三个部分,共约 20000 多字。第一部分,案情

3、概要和主要争议焦点。在介绍案件的基本情况下,总结案件的争议焦点:剧本剽窃的认定标准、剧本署名权问题、剧本作者对影视作品的后续利用享有的权益。我国法律对剽窃的认定标准没有作出规定,著作权法只是将剽窃作为侵犯著作权行为之一。著作权法对署名权问题的相关规定并不能解决署名位置、方式、顺序等新出现的署名权纠纷。著作权法对剧本作者和影视作品的关系未做出界定,实践中也不能明确影视作品著作权人对影视作品的改编、发行小说等后续利用行为是否需征得剧本作者同意。第二部分,问题争议点的法律分析。本部分主要分析影视剧本著作权保护中所出现的三个主要问题:首先,关于剽窃的认定标准。学术界对认定剽窃的观点不一:时间判断法、比

4、较判断法、调查判断法、程度判断法等。实践中认定剽窃主要有三种标准,即“接触加实质性相似标准”、 独创性标准”、“三步判断法标准”。三种标准在适用上都有难点:哪些内容构成实质性相似;在判断独创性时可能侧重剧本本身而忽视了创作过程,或者只比较部分而忽视整体;运用三步法标准时如何区分思想与表达。其次,关于编剧署名权。实践中新出现的侵犯署名权的现象,主要涉及署名的方式、顺序、位置,著作权法对此未有规1西南政法大学硕士学位论文定,对此问题有涉及的只有最高法院的解释、相关高院的解答及广电管理局发布的文件等。最后,关于剧本作者和影视作品的关系。分析了国际上关于原作品与影视作品间的法律关系的两种立法模式,即演

5、绎作品模式和合作作品立法模式。我国的立法对两者关系及编剧的“二次获酬”未作明确规定。著作权法修改草案虽然做了补充,但关于付酬主体、权利的性质等问题还是有待完善。第三部分,从本案看影视剧本著作权纠纷案的法律适用。主要探讨本文第二部分中的三个问题的法律适用,在司法实践中应如何处理。在立法缺失的情况下如何合理、适当地解决纠纷。同时分析本文案例中涉及的争议焦点的处理结果。关键词:著作权;影视剧本;剽窃;署名权;影视作品后续利用2论影视剧本的著作权保护以警中警著作权纠纷案为视角AbstractProtecting the copyright of film and television scripts

But the copyright law of our country on scriptsprotection is not clear. The disputes of scripts copyright usually are script plagiarism,new disputations of the rig

7、ht of authorship, writers rights on the subsequent use ofworks etc. But the copyright law of our country can not solve these problems. Tosolve these problems, we have to research the copyright protection of film andtelevision scripts.The paper starts from the case and elaborates on the key problems

8、appeared inpractice and researches shortcomings of the copyright law of our country on scriptsprotection, then put forward countermeasures to solve relevant problems.In addition to the introduction, this paper is divided into three parts. There aremore than 20000 words.Part one, case summary and the

9、 primary disputes. Firstly, the paper introducesthe case summary, then summaries the main controversies: the standard of scriptplagiarism, the disputation of the right of the writers authorship, writers rights on thesubsequent use of works. The copyright law of our country do not rule on the standar

10、dof script plagiarism, only regards it as a behavior of copyright infringement. ThePeoples Republic of China Copyright Law can not solve the new disputations on theright of the writers authorship, such as how to express the writers right of authorship,in which position, in which method, in what orde

The law on the relationshipbetween the writer and the film and television work is not clear, so in practice, we donot know if the produces should get the consent of the writer for the subsequent use ofthe works, such as the work adaptation, the novel distribution etc.Part two, legally analysis of

12、 the disputations. This part mainly analyses threemain questions: firstly, the distinguishing standard of plagiarism. The academiccircles dont have a standard on the plagiarism distinguishing, the main standards arefollowing: time judgment rule, comparison judgment rule, research judgment rule,degre

13、e judgment rule etc. In practice, there are three standards, that is “contact plussubstantial similarity standard” and “originality standard” and “three steps judgmentstandard”. 14、rity? When judging originality, we may payattention to the whole scripts but ignore the writing process, or only compare the partbut ignore the whole. In the use of the “three steps judgment standard”, how to tell thethought from the expression is a difficulty. Secondly, about the writers right ofau

15、thorship. The new phenomenons of infringement of the right of authorship arefollowings: to express the writers right of authorship, in which position, in whichmethod, in what order. Our countys copyright law do not define those questions, onlythe judicial interpretation of the supreme court , the re

16、levant courts file and the file ofthe administration of radio and television have relevant provisions about the problems.Finally, about the relationship between the writer and the film and television work.The paper analyses two kinds of legislative model on the international, that isderivative work model and cooperative model.
