1、2将使合同关系归于消灭。若对合同解除权的行使期限不作任何限制,必然会影响法律关系的稳定性,甚至会损害相对人的合法权益。因此,为了平衡合同解除权人、相对人以及维护法律关系的稳定性,合同解除权的行使应受权利失效原则的制约和限制。因此,本文分析了三个代表不同类型的合同解除权案件,以求类型化案例,供法律实务部门和法学理论者参考。合同解除权作为一种典型的形成权,其行使理应遵循形成权的行使规则。法学理论研究上,形成权的行使规则,主要是围绕权利行使的主体,权利行使的方式以及形成权的行使不得附条件或期限等问题展开。本文基于合同解除权的具体情形,从合同解除权的行使主体和行使方式两方面进行论述。其中,合同解除权的

2、行使方式包括明示和默示两种方式。合同解除权人的通知义务并不构成请求法院或仲裁机构裁决解除合同的前置程序。另,关于合同解除的方式在理论上也存在争议,笔者观点是自动解除不是合同解除的一种方式。为了维护自身的合法权益不被侵害,同时,也对权利人行使合同解除权形成制约,法律赋予了非解除权人向法院或仲裁机构提起异议。非解除权人的异议并非一种请求权,而是非解除权人所有的一项法益,是向法院或仲裁机构提起确认之诉的实体法依据。另,为及时确定法律关系以及使合同解除权人及时明晰法律关系的存废状态,非解除权人的异议理应受法律期间的限制。但是目前中国合同法关于异议的行使规则和合同解除权的除斥期间等规定,均存在着制度内容
