1、Regulation of Guangdong Province on the Payment of Wages(Adopted at the 16th meeting of the Standing Committee of the 10th Peoples Congress of Guangdong Province on January 19, 2005)Chapter I General ProvisionsArticle 1 For the purpose of regulating the payment of wages, safeguarding the rights of e
2、mployees to get remunerations for their labor, establishing a harmonious labor relationship and promoting social stability and economic development, this Regulation is formulated in accordance with the Labor Law of the Peoples Republic of China and the relevant laws and administrative regulations, a
3、nd in combination with the actual situation of this Province.Article 2 This Regulation shall apply to enterprises, private non-enterprise entities and individual economic organizations (hereinafter referred to jointly as employing entities) within the jurisdiction of this Province and the employees
4、who have established labor relationship therewith.The state organs, public institutions and social organizations within the jurisdiction of this Province and the employees who have established labor relationship therewith shall be governed by this Regulation through analogy.第 一 章 总 则第 一 条 为 规 范 工 资
5、支 付 ， 保 障 劳 动 者 取 得 劳 动 报 酬 的 权 利 ， 建 立 和 谐 的 劳 动 关 系 ，促 进 社 会 稳 定 和 经 济 发 展 ， 根 据 中 华 人 民 共 和 国 劳 动 法 和 有 关 法 律 、 行 政 法 规 ，结 合 本 省 实 际 ， 制 定 本 条 例 。 第 二 条 本 条 例 适 用 于 本 省 行 政 区 域 内 的 企 业 、 民 办 非 企 业 单 位 、 个 体 经 济 组 织（ 以 下 统 称 用 人 单 位 ） 和 与 之 形 成 劳 动 关 系 的 劳 动 者 。 国 家 机 关 、 事 业 单 位 、 社 会 团 体 和 与 之 建
6、 立 劳 动 合 同 关 系 的 劳 动 者 ， 依 照 本 条 例 执行 。Article 3 The Provincial Peoples Government shall formulate a minimum wage standard pursuant to the relevant provisions, and the peoples governments at or above the level of districted city shall determine the minimum wage levels of their respective cities with
7、in the minimum wage levels as promulgated by the Provincial Peoples Government. The peoples governments at or above the county level shall regularly announce the guiding wage and guiding wage level of the labor market, and provide guidance and services to the employing entities and employees.第 三 条 省
8、 人 民 政 府 按 照 规 定 制 定 最 低 工 资 标 准 ， 地 级 以 上 市 人 民 政 府 应 当 在 省 人 民 政府 公 布 的 最 低 工 资 标 准 中 确 定 本 市 的 最 低 工 资 标 准 。 县 级 以 上 人 民 政 府 应 当 定 期 公 布 劳 动 力 市 场 工 资 指 导 价 位 和 工 资 指 导 线 ， 并 为 用人 单 位 和 劳 动 者 提 供 指 导 和 服 务 。Article 4 The wages shall be paid on schedule, in full amount and with priority. Where an
9、employee provides normal labor within the statutory working hours or the working hours as stipulated in the labor contract, the employing entity shall determine his wage standard not lower than the local minimum wage level.第 四 条 工 资 支 付 实 行 按 时 足 额 、 优 先 支 付 原 则 。 劳 动 者 在 法 定 工 作 时 间 或 者 劳 动 合 同 约 定
10、 的 工 作 时 间 内 提 供 正 常 劳 动 的 ， 用 人 单位 确 定 其 工 资 标 准 不 得 低 于 当 地 最 低 工 资 标 准 。Article 5 The peoples governments at all levels shall establish and improve their respective early-warning mechanisms of wage payment, credit supervisory mechanisms and emergency handling mechanisms.第 五 条 各 级 人 民 政 府 应 当 建 立
11、健 全 工 资 支 付 预 警 机 制 、 信 用 监 督 机 制 和 应 急 处 置 机 制 。Article 6 The administrative departments of labor and social security of the peoples governments at all levels (hereinafter referred to as the labor and security department) shall be responsible for the guidance, supervision and inspection of wage pay
12、ment by employing entities within their respective jurisdictions.The departments of industry and commerce, construction, customs, taxation, and the banks shall help the labor and security department in the respect of supervision over the payment of wages within their respective functions.Labor union
13、s and womens federations shall lawfully maintain the rights of employees for remuneration for their labor.Any entity or individual shall have the right to report any illegal act related to the payment of wages.第 六 条 县 级 以 上 人 民 政 府 劳 动 和 社 会 保 障 行 政 部 门 （ 以 下 简 称 劳 动 保 障 部 门 ） 负 责 对本 行 政 区 域 内 用 人 单
14、 位 的 工 资 支 付 行 为 进 行 指 导 和 监 督 检 查 。 工 商 、 建 设 、 海 关 、 税 务 等 有 关 部 门 和 银 行 ， 应 当 在 各 自 职 责 范 围 内 协 助 劳 动 保 障部 门 对 工 资 支 付 行 为 实 施 监 督 。 工 会 、 妇 联 等 组 织 依 法 维 护 劳 动 者 获 得 劳 动 报 酬 的 权 利 。 任 何 单 位 和 个 人 有 权 检 举 工 资 支 付 的 违 法 行 为 。Chapter II Payment of WagesArticle 7 An employing entity shall establish
15、its system on the rules of wages according to law, and make it known to all the employees thereof in written form.The rules for payment of wages shall cover the following matters:(1)Ways for distribution of wages, items, standards and methods for the determination and adjustment thereof;(2)Period an
16、d date for the payment of wages; (3)Overtime wages, wages for extra working hours, wages for special circumstances, and the payment methods thereof;(4)Wages to be withheld and deducted, and the withholding and deduction matters; and(5)Other relevant matters.An employee is entitled to inquire the employing entity about the contents of the rules on the payment of wages.第 二 章 工 资 支 付第 七 条 用 人 单 位 应 当 依 法 制 定 本 单 位 的 工 资 支 付 制 度 ， 并 书 面 告 知 本 单 位 全 体劳 动 者 。
