5、 正 义 的 经 验 研 究 ， 他 善 于 从 一 个 微 观 的 、 历 史 的 视 角 去 窥 探 现 实 社 会 和 生 活 中 所 蕴 藏 的 日 常 正 义 。 并 相 继 形 成 了 “局 部 正 义 ”和 “转 型 正 义 ”两 种 主 要 的 正 义 观 。 其 中 ， 局 部 正 义 是 一 种 空 间 上 的 正 义 ， 而 转 型 正 义 则 是 一种时间上的正义。“局 部 正 义 ”从 一 种 情 境 途 径 去 研 究 分 配 正 义 问 题 ， 它 是 对 传 统 正 义 理 念 的 一 种经验化和科学化。 在分析局部空间中的社会机构如何分配稀缺物品和必要负担时，
6、 埃 尔 斯 特 运 用 了 大 量 科 学 机 制 来 解 释 社 会 行 为 人 的 动 机 、 偏 好 如 何 形 成 及 聚 合 、 集 体 行 动 等 问 题 。 它 为 我 们 研 究 正 义 主 题 开 辟 了 一 条 新 的 道 路 和 视 野 ， 因 此 值 得 我 们 深 入 研 究 。 本 文 首 先 概 括 性 地 把 握 了 “局 部 正 义 ”的 总 体 特 征 ， 以 直 接 或 间 接 的 方 式 展 示 了 局 部 正 义 自 身 属 性 及 与 他 者 的 比 较 ， 以 及 在 整 个 “正 义 ”理 论 中 的 位 置 。 第 二 章 提 出 了 “局
7、部 正 义 ”的 几 个 基 本 概 念 ， 比 如 “局 部 ”和 “正 义 ”、 “物 品 ”和 “负担” ； 第三章详细介绍 了 “局部正义” 的实现形式： 首先提出了大量的西方社会 中 的 分 配 实 践 案 例 ， 紧 接 着 将 相 应 的 正 义 原 则 引 入 到 纯 粹 的 案 例 分 析 中 ， 最 后 分 析 了 社 会 行 为 人 采 取 这 些 分 权 化 的 分 配 原 则 导 致 的 后 果 。 由 此 可 见 ， 局 部 正 义 就 是 在 不 同 的 时 间 和 空 间 中 ， 社 会 机 构 如 何 利 用 正 义 原 则 来 分 配 稀 缺 资 源 和 必

9、at values on the empirical study of justice, by imposing a historical and micro-perspective on the everyday justice underlying citizens social life. Ultimately, Elster mainly developed two conceptual and theoretical frameworks of justice in succession, which have been extensively regarded as Local J
10、ustice and Transitional Justice. Generally speaking, the former belongs to the spatial justice category, while the later corresponds to temporal justice.Local justice stands for “Contextualism”, by and large，Contextu alist advocated asituational way for surveying distributing justice. Therefore, Loc
11、al justice put traditional ideas of normative justice into an empirical and scientifical way. The empirical studies focus, then, on the local institutional allocation of scarce goods and necessary burdens, as explaining the motives, preferences and collective actions of social actors in terms of “me
12、chanisms”. As mentioned above, Local justice explored a broader way for us to study justice, so its worth of being deeply researched. I first characterized total pictures of local justice, emphasizing some inner properties and features of itself, by virtue of comparisons between Elster and other the
13、orists, whose perceptions of justice are relevant. Secondly, I proposed several basic ideas about local justice with internal logical distinctions, such as “local” and “justice”, “goods” and “burdens” as well. In the third part, I detailedly illustrated various forms of realizing local justice, whic
14、h contains three parts: First, I enumerated a number of examples, taken mainly from contemporary Western societies, just on a case-by-case basis. Second, I reshuffled the same problems, so as to organize them around the principles that are used in solving them; Third, I pointed to consequences of th
15、ese discretionary decisions held by social agents. In the forth part of this paper, I moved on to analyze Elsters explanatory framework of local justice, which intentionally and casually explained the social behaviors of local allocators. Finally, I shall draw attention to some unexplored issues, such as interpersonal comparisons, sustainable development, local justice in China,etc. In doing so, I just suggest some analysis and directions for further research.Key words: Elster, Local Justice, Realization Form, Explaining Framework, Interpersonal Comparisons目 录摘 要 .
