1、河南大学 硕士学位论文 河南省城镇高中学生体育权利的现状与维护 姓名：李黎明 申请学位级别：硕士 专业：学科教学（体育） 指导教师：殷红；于自强 2011-05 V 摘 要 摘 要 随着人类文明的进步以及法自身不断的发展， 公民权利已经成为了世界各国宪法和 法律的核心内容。 而且伴随着社会的发展， 体育的社会地位和价值也在逐渐的得到体现， 体育与人们生活的关系也在日渐变的紧密起来。 学校体育作为社会体育与竞技体育的基础， 它是我国教育事业和体育事业重要的组 成部分，包括了各类学校的体育课教学、课外体育活动、课余体育训练和体育竞赛。学 校体育活动不但可以促进学生的生长发育，而且能够使学生形成健身
2、、娱乐、生活等方 面的多种身体技能， 提高学生对体育文化的认识， 使其在学校体育教学中形成良好的思 想、品德和生活习惯，让学生在校学习期间拥有充沛的学习精力，能够全面促进学生身 心地协调发展。因此，学校体育有着非同一般的地位与意义。但是近些年以来，因为学 校体育引起的学生与学生、 学生与学校之间的伤害赔偿纠纷在不断地增多， 高额赔偿金 以及所要担负的法律责任使得很多学校往往对体育课采取比较消极的做法； 有些学校对 体育认识远远不够，甚至认为花钱去买器械就是浪费，能不上就不上体育课，更有严重 者把体育课改成其他课程，比如笔者曾经实习过的一个学校，从来就没有开过运动会， 体育课经常就是自习课， 学
3、校的这些做法都是在侵犯学生的体育权利。 摆在立法者和教 育工作者面前的一个很重要的理论和实践问题就是如何确认和保护学生的体育权利。 因 此，深入研究学生的体育权利，了解学生体育权利在内的权利法系，通过研究能够将其 写入法律，形成能够保障学生体育权利的条文，这样不但有利于学校更好地落实“以人 为本”的科学发展观，纠正诸多侵犯学生体育权利的行为，规范学校的教育行为，而且 保障了学生各种体育利益的实现， 培养和提高学生的体育权利与维权意识， 让学生能够 自觉地运用法律武器去维护自身合法的体育利益。 河南作为一个人口的大省，又处在我国的中原地带，体育的发展的确不容乐观，这 其中就包括学校体育， 学校中
4、学生的体育权利被侵害的事件时时刻刻都存在着， 学生的 体育权利得不到保障， 享受不到体育带来的快乐与健康， 严重影响河南省体育后备人才 的发展，而高中作为体育发展的重要阶段，学生体育权利得到保障事关重要，直接影响 着河南省体育的发展， 由此可见， 对河南省城镇高中学生体育权利的研究存在着必然性 和紧迫性。 VI 本文对河南省部分城镇高中学生体育权利的状况进行调查， 旨在全面了解和掌握学 生体育权利的状况，使学校、教师能深入地认识到学生体育权利得不到保障的后果，使 学生更加理解体育权利的重要性， 培养和提高学生的体育权利意识， 让学生学会运用法 律去维护自身合法的体育利益，从而维护学生、学校和教
5、师的权益，保证学校体育工作 的正常开展， 为切实推进学校体育中的素质教育和依法治教、 依法治体提供一些理论参 考。 关键词：城镇高中，学生体育权利，维护 VII ABSTRACT ABSTRACT With the advance of the human civilization and the development of its constant law, civil rights has become the core content of the constitution and the law in the world. And with the development of so

As social sports and athletic sports foundation in China, The school sports is the important basis of education career and sports, including physical education cla
7、ss teaching, extracurricular sports activities, extracurricular sports training and competitions. The school sports activities not only can promote students growth, but also can make students form fitness and entertainment, life etc many kinds of physical skills, enhances the student to the physical
8、 cultural knowledge in the school sports teaching form good ideas, moral character and living habits, lets the student in the school study with abundant energy during the study, can promote students mind and body to coordinate development. Therefore, the school physical education is extraordinary po

But in recent years compensation disputes on hurt increases between the school students and students, students and the schools caused by school sports, that high compensation, and liability to be responsible for making many schools tend to adopt a more passive physical Pract
10、ices; some schools is not enough understanding of sports, and even that is a waste of money to buy equipment that can not on the physical education, more severe is to change physical courses to other courses, such as I once had a school internship , that school has never held a sports competition, p

Placed in front of legislators and educators is a very important theoretical and practical issue is how to recognize and protect the rights of students in sports. Therefore, we sh
12、ould further study students sports rights, understand the student sports rights, rights law, through the research can legally binding, form that can ensure the provision of student sports rights, such not only help the school to better implement people-oriented scientific development view, correctin
13、g many infringe the rights of student sports, regulating the school education behavior , and also guarantee the students the realization of the interests of the various kinds of sports, training and improving students sports rights and rights protection consciousness, that students can consciously u

As a population of Henan province, also in Chinas Central Plains area, the development of sports really is not optimistic, and these include school sports, there are too many events that sports rights of students are infringed at all times,
15、and students sports rights are not well protected, so that they can not enjoy the pleasure of sports and health, which serious impact on the development of Henan Sports Reserve, but high school sports development as an important stage, that students sports rights are guaranteed is essential which ha
16、s a direct impact on sports development in Henan province, we can see, There is necessity and urgency to the research on sports rights of urban high school students in Henan province .
