3、过介绍网络的特点， 引入了网络自由化这一全新的概念。网络具有虚拟性、自由开放性和灵活性的特点，这 对国家主权的维护产生了一定的影响。网络自由化是一个渐进的过程,是逐步形成和发 展的。网络自由化是一个相对的概念，并非是绝对的自由，也并非西方吹嘘的“网络自 由”战略。 传统之国家主权理论主要形成于西方资产阶级思想家的论著中。 国家主权理论经历 了从古典主义主权观念萌芽到近代国家主权理论的产生发展再到国际法法理中的主权 观。时至今日，关于国家主权理论的新观点层出不穷，比如“新主权理论” 。 网络自由化给国家主权理论带来了政治、经济、文化上的冲击，给国家主权的维护 带来了难度。 网络自由化通过渗入到国
4、际组织发展之中以及国际合作的深入对国家政治 主权带来挑战。网络自由化通过经济全球化、跨国公司、金融全球化对国家经济主权产 生冲击。 网络自由化是通过加强文化的发散性和弱化民族国家本国文化的认同感等手段 对国家文化主权带来挑战。同时，网络自由化也对国家主权的维护有着促进作用。网络 自由化有利于加强民主管理、保障人权；促进国际沟通、创造宽松的国际环境。 在网络自由化的大趋势中该如何处理网络自由化与维护国家主权的冲突，笔者认 为，即在坚持国家主权原则的基础上，对网络自由化进行规制。具体的做法有：加强网 络管理，营造和谐的网络环境；增强综合国力，提高国际竞争力；积极参与国际合作， 建立公正合理的国际网
5、络秩序。 关键词 网络 网络自由化 国家主权 冲击 促进 Abstract II Abstract As the liberalization of network development, the traditional theory of national sovereignty has been a challenge to do exposition, this paper focuses on the impact and influence of the network of liberalization on the theory of national sovereignty.
6、 First of all, the author introduces the characteristics of the network, the introduction of this new concept of network liberalization. Network with virtual freedom of openness and flexibility characteristics and maintenance of national sovereignty have had some impact, and author in the first part
7、 of these features in-depth analysis. Network liberalization in the end is kind of a concept, it is a relative concept, is not absolute freedom, is not Western-vaunted “network freedom“ strategy. Traditional state sovereignty theory development process is mainly produced in the Western bourgeois rev
8、olutionary thinkers of the author described in detail in the text. The theory of state sovereignty has gone through the development and to the concept of sovereignty in international law jurisprudence from the seeds of the neoclassical concept of sovereignty to the theory of modern national sovereig
9、nty. Today, an endless stream of new ideas on the theory of national sovereignty, such as “sovereignty theory“ and “jurisdiction relative theory“. The liberalization of the network theory of national sovereignty to bring political, economic and cultural impact on the maintenance of national sovereig
10、nty difficult. Network liberalization challenges the sovereignty of the countrys political development and the deepening of international cooperation through international organizations. Network liberalization by economic globalization, multinational corporations, financial globalization on the sove
11、reignty of the countrys economic impact. The liberalization of network challenges is through the strengthening of cultural divergence and weaken the nation-state national cultural identity of national cultural sovereignty. At the same time, the liberalization of network is the maintenance of nationa
12、l sovereignty role. Network liberalization to strengthen democratic management, and protection of human rights; promote international communication, to create a relaxed international environment. Abstract III Trend of liberalization of the network, how to deal with the liberalization of network conf
13、lict and to safeguard national sovereignty, I believe that adhering to the principle of national sovereignty on the basis of regulation of network liberalization. The specific practices: network management, to create a harmonious network environment; enhance overall national strength, and improve th
