1、山东农业大学 硕士学位论文 农区林业产权制度改革研究-以新泰市集体林改为例 姓名：刘丹君 申请学位级别：硕士 专业：农业推广 指导教师：张维 2010-12-12 山东农业大学硕士专业学位论文 I 摘 要 随着经济与社会的发展， 产权这一新生事物在经济发展过程当中的作用显得 越来越重要，可以说产权已成为现代经济生活必不可少的要素。但是产权本身又 是一个非常复杂的事物，尤其是对林业产权来说更是如此，因而其构成的林业产 权制度也是一个系统的整体。由于各种原因，林业产权制度在经济发展过程中会 出现与之不相适应的地方，故进行林权制度的改革则成为重要的任务。本文中首 先论述了有关产权、林业产权、农区林业
2、产权制度的基本概念,分析了我国现有 农区林业产权制度改革中存在的权利主体不清、经营自主权被弱化、产权交易不 规范等问题，并提出了解决这些问题的基本的对策，后以新泰市有关林权制度改 革的实际案例来简单说明有关的问题并得出一些初步的结论。 本文认为，林权制度改革中存在的主要问题主要包括：林业产权的基本构 成要素不清晰，林权主体虚置，所有者与经营者的权、责、利不统一。林业产 权不稳定、权属多变，林农缺乏安全感和稳定感。良好的产权交易制度体系未 建立，产权交易不规范，严重影响权益稳定。林权委托代理关系扭曲，经营自 主权被弱化，林地林权管理不到位。林权流转体系模糊，效率不高。思想认 识不统一, 缺乏改革
3、的自觉性、主动性等。那么文章就这些问题给出的一些基本 对策，如加快和完善林业产权法制化建设进程，力求做到产权界定清晰，尽快出 台并完善相关配套政策，尽快彻底解决林权证发放问题。稳定和完善林权使用权 流转制度，加强林业产权管理，积极构建林业产权市场交易体系,通过各种途径， 不断提高林农的产权意识。 文章以泰安新泰市为实际案例，阐明了新泰市林业发展的基本概况、说明了 其近期实施林权制度改革的基本原则、效果及简要评析， 最后一个部分，文章给出了新泰市林权制度改革的制度设计，简要分析了设 计内容的指导思想、总体目标以及主要内容等。文章指出，积极鼓励发展地区林 业，应该切实结合地方实际实现林业的适度规模
4、经营，政府应鼓励发展林业专业 合作组织。研究并给出了新泰市林权制度改革的一些建议，如进一步明晰林业产 农区林业产权制度改革研究以新泰市集体林改为例 II 权，理顺产权关系，积极建设林业要素市场，努力构建林业产权交易平台,进一 步深化林权交易体系，积极促进林业市场体系的不断完善和林农增收。最后则是 深化林业体制改革，大力发展非公有制林业，不断完善林业经营管理体制，全面 做好配套服务工作等几点。 关键词：农区 产权制度 农区林业产权 林权制度改革 山东农业大学硕士专业学位论文 III Abstract With the development of economy and society， pro
5、perty rights，the new thing ,is increasingly playing an important role in the process of economic development and we can say it is now the very essential contribution for the modern lives of economy. However, property rights is very complex, especially for the Forestry Property, so the Forestry Prope
6、rty is also a systematic one. It is not adapted in the development of economy on account of many reasons ,then the reform of the Forestry Property is becoming more and more important for us. In this passage , firstly we can learn some basic conceptions about the Property、the Forestry Property and th
7、e Agroforestry system of Property Rights and then analyse some problems in this reform process, such as the unclear rights of the subject、 the weak operational autonomy and non-standard property rights, and this thesis will put up for many solutions for us. Then this it will illustrate some concerni
8、ng problems through an actual case about the reform of forest right system in XinTai city and try our best to acquire basic primary conclusions for the study. This paper thinks that the main problems contained in the reform of forest right system are as the flowerings：The basic elements of forestry
9、property rights is not clear, the right of the main subject is not virtual, power and responsibilities and interests of owners and operators are not unified. Forest property rights are unstable, ownership often changes and foresters lack of a sense of security and stability. A good trading system of
10、 property rights is not well established, the property rights are non-standard and it affect the stability of interests seriously. The relationship of principal-agent between forest ownership is distorted, operational autonomy has been weakened and the management of woodland or forest rights is also
11、 not in place. The transfer system of forest ownership is vague and does not carry high efficiency. The thinking of foresters is not unified, lacking of consciousness and initiative of reform and so on. So the article gives some of the foundemental measures on these issues to accelerate and improve
12、the process of building the legal system of forestry property rights, to strive to achieve well-defined property rights, and to improve the relevant supporting policies, or to promptly resolve the issue of forest warrants issueing. Stabilize and improve the transfer system of use of forest ownership
13、 right , or to strengthen the management of forest property rights , and actively build a trading system of forestry equity market as well as improve the property rights of awareness of foresters through various channels. 农区林业产权制度改革研究以新泰市集体林改为例 IV The article illustrates the reality of development o
14、f basic forestry profiles with the actual case of Xintai and demonstrates the basic principles, effects and brief assessment in its the forestry right system reform that recently implemented. Finally,the article gives the response to the reform of forest tenure systems design of Xintai and a brief a
15、nalysis of the design content of the guiding ideology, overall objectives or main content. The passage points out local conditions should be practical to achieve the modest scale of forestry so as to actively encourage the development of regional forestry,while the Government should encourage the de
16、velopment of forestry professional cooperative organizations. Besides the paper also gives some of the reform proposals about it, for example, clarify property rights further , strengthen out the relationship of property rights and establish forestry factor markets actively or try our best to build a trading platform of forest property right.
