1、湘潭大学 硕士学位论文 土家族婚姻习俗与婚姻法的冲突和调适 姓名：颜晖 申请学位级别：硕士 专业：法律民商法学 指导教师：谭桂珍 20061001 I 摘 要 摘 要 本文所考察的土家族，以民族生活范围来定,主要是指居住在湘西土家族苗族 自治州(以下简称湘西自治州)及周边地区的土家族居民。 中华人民共和国婚姻 法和中华人民共和国继承法颁布实施以来,在少数民族土家族地区实施取得 了良好的社会效果。但仍有一些土家族婚姻习俗与我国婚姻法之间存在冲突,并给 我国婚姻法有效实施和加强少数民族地区法制建设构成了障碍。因此,研究这种冲 突现象并找寻调适之对策，以实现土家族婚姻家庭习俗与国家婚姻法相融合之目
2、的尤显意义重大，这也是笔者写作本文的目的和主题所在。目前国内有朱苏力、 高其才、田成有等学者对少数民族习惯法与国家制定法二者关系与互动进行了一 定的研究，但均偏重理论指导，缺少对土家族婚俗与婚姻法冲突与调适具体进行 研究和论证。因此,本文旨在就以上学者讨论和研究的理论基础上，尝试运用实证 分析的研究方法，并辅以比较研究和历史研究的方法对土家族婚俗与婚姻法具体 冲突与调适作一具体研究和论证。 本文分为四章，第一章引言，引出本文要论述的文章主题；第二章介绍了土 家族主要现有的婚俗规范；第三章着重分析指出和比较了土家族婚俗与婚姻法的 冲突表现和二者冲突形成的原因及后果；第四章主要论述了土家族婚俗与婚
3、姻法 冲突调适的规则，并对土家族婚俗与婚姻法冲突提出了具体调适之方法。本文的 研究成果的现实意义在于通过对土家族婚俗与婚姻法冲突提出明确的调适规则和 方法，一是能较好的化解土家族婚俗与婚姻法之间存在的冲突；二是能进一步完 善规范我国婚姻法立法和司法，为民族自治地区的土家族婚俗改革发展，进一步 拓宽了理论和实务上的路径；三是本文论述的土家族婚俗与婚姻法冲突的互动调 适的规则和方法，对解决其他民族自治地方的少数民族婚俗与国家婚姻法的冲突 和调适问题，具有一定的参考价值。 关键词：土家族；婚姻习俗；婚姻法；冲突；调适 II ABSTRACT Tujia nation that this text i
4、nvestigated, in view of the national life range, mainly mean the Tujia residents that live in Tujia-Miao Autonomous Prefecture (hereafter referred to as the automonous prefecture of western Hunan) and surrounding area. Since “ Marriage Law of the Peoples Republic of China “ and “ inheritance law of
5、the Peoples Republic of China “ are issued and implemented, the good social effect has been made in Tujia area. But some conflicts exist still between some marriage customs of Tujia and marriage law of our country and have formed the obstacle of implementing the marriage and family inheritance law o
6、f our country effectively and strengthening the legal construction of minority area. So, studying the conflict phenomenon to look for countermeasures and to realize the purpose of merging Tujias custom and national law about marriage and inheritance family is of great significance particularly, this
7、 is purpose of authors writing and theme herein too. Zhu Su li, Gao Qi cai, Tian Cheng you and so on scholars have carried on certain research about relation and interdynamic between the custom law of minority and state law at present at home, but all of them lay particular stress on the theoretical
8、 direction, lack specifical research and proving about conflicts and adjusting rightly of Tujias marriage custom and the marriage law. So, on the theoretical foundation which the above-mentioned scholar discuss and study, trying to use the real example to analyze, and complementing the method to stu
9、dy in comparative study and history, this text aims at making concrete research and proving of conflicts and adjusting between Tujias marriage customs and the marriage law. This text is divided into four chapters, chapter one is foreword and draws the articles theme that this text should describe; C
10、hapter two has introduced Tujias main and existing marriage customs norm; Chapter three analyze, point out and compare conflicts and reason and consequence of conflict between Tujias marriage customs and marriage law emphatically; Chapter four has mainly expounded the rule of adjusting the conflict
11、between Tujias marriage customs and the marriage law, and has put forward the specifical method of adjusting. The realistic meaning of the research herein lies in putting forward the principle and methods of adjusting the conflict, first, this can solve the conflict of Tujias marriage customs and th
12、e marriage law; second, can further complete and regulate our legislation and justice about marriage, widen the route on theory and practice for reform and development of Tujia nations marriage custom; third, these principles and methods have certain reference value for solving and adjusting rightly
13、 of conflicts between minorities marriage custom in other national autonomous regions and the marriage law of our country. 15、 引 言 土家族（自称毕兹卡，意为本地人） ，是一个历史悠久、勤劳勇敢的少数民族。 经过历代的迁徙，现大部分土家族人居住在湘、鄂、渝、黔四省交界的地区,湖南 湘西土家族苗族自治州是土家族居住最为集中的地方之一。长期以来,由于社会、 经济、文化等因素的影响,土家族形成了他们独有的婚姻习俗。 自中华人民共 和国婚姻法(以下简称婚姻法)和中华人民共和国继承法以下简称继 承法颁布实施以来,传统落后的土家族婚姻习俗被改革,一些不符合文明进步的 婚姻习俗制度被扬弃,法律的实施取得了良好的社会效果。虽然习俗与法律属于两 个完全不同的范畴,但二者却有着割不断的联系,正如卢梭所言“风俗习惯形成了 国家真正的宪法
16、,它每天都在获得新的力量。当其他的法律衰老或消亡的时候，它 可复活那些法律或代替那些法律，它可以保持一个民族的创新精神，却可以不知 不觉地以习惯的力量代替权威的力量。 ” 习俗与法律间的这种关系必然使二者发 生冲突,这种冲突在以身份关系为主导的婚姻家庭中表现尤为突出。五十多年来, 土家族婚姻习俗与婚姻法之间的冲突, 给国家法律的有效实施和加强民族地区自 治法制建设构成了障碍。因此,研究这种冲突现象并找寻调适之对策尤显意义重 大，这也是本文写作的动机和目地所在。目前国内多为基本理论的研究，如少数 民族习惯法与国家制定法二者关系与互动研究，如朱苏力、高其才、田成有等教 授。而对于土家族婚俗与婚姻法具体调适的研究并不多见，国内学者主要是蓝寿 荣、柏贵喜、瞿州莲老师对此进行了一定研究，但均偏重理论指导，没有对土家 族婚俗与婚姻法具体冲突与调适进行研究和论证。本文写作的思路就是以上学者 讨论和研究的基础上，尝试对土家族婚俗与婚姻法具体冲突与调适作一具体研究 和论证。 本文所考察的土家族，以民族生活范围来定，主
