1、Y ， U G 1 。 。 内 容 提 要 所谓“ 洗钱” ( mo n e y la u n d e r i n g ) ， 是指隐瞒或掩饰犯罪收益并使之表 面来源合法化的活动和过程。反洗钱犯罪现状在中国至今可以说是一个非常陌生 的领域，既没有成熟的理论研究成果可循.又无可行的实践经验所依，造成这种 现状的原因很多。本文分为七大部分，由引言、正文五部分、小结组成。引言主 要介绍国际反洗钱和我国反洗钱法律制度的现状，以及研究的价值及意义;正文 第一部分介绍洗钱的内涵和洗钱犯罪的现状;正文第二部分介绍美国反洗钱法律 制度概述;正文第三部分介绍我国反洗钱制度建设和立法完善的思考:正文第四 部分介绍

2、我国中央银行的地位与反洗钱;正文第五部分介绍我国积极参加全球反 洗钱运动;小结部分从总体上回顾本文，进一步论证本文观点。 中国反洗钱行动将面临严峻挑战。所以我们必须加强反洗钱的立法研究及反 洗钱的工作制度建设。以适应当前打击愈演愈烈的洗钱犯罪，维护我国金融体系 的稳定和安全。纵观世界各国打击洗钱犯罪的成果和丰富的经验，我们应该从反 洗钱的预防和打击等多方面学习他国， 借鉴有益的制度和有效的方法。美国是世 界土最早制定法律打击洗钱犯罪的国 家，在这方面有着完善的法律制度体系和丰 富的实践经验。值得我们很好的研究，以探求出适应我国的立法模式及反洗钱制 度。 新修订的 中国人民银行法 规定 “ 中国

3、人民银行组织协调国家反洗钱工作， 指导、部署金融业反洗钱工作，负责反洗钱的资金检测”职责。明确了中国人民 银行负责统一监管、协调我国金融机构反洗钱工作，制定反洗钱工作制度及大额 和可疑人民币 资金交易报告制度，并建立支付交易监测系统对人民币 大额和可疑 交易信息进行收集、分析。但是仍然不够具体，缺乏操作性，要解决我国在反洗 钱方面的法律欠缺及被动局面，应当进一步明确中央银行反洗钱的职责。 关键词:洗 钱 反 洗 钱法 律 美国 中 国 人民 银 行 另 少 作 常、 导 师 同 冬 J I 全文公 布 Ab s t f a C t m o n e yl a u nde r i n gd e n
