1、房屋租赁合同范本 出租方:(以下称甲方) 承租方:有限公司(以下称乙方) 为了使甲、乙双方合作愉快根据合同法及有关规定为明确甲方与乙方的权利义务关系经双方协商一致签订本合同 一、租赁物的名称: 甲方将位于的集住宿、餐饮、娱乐为一体的宾馆租给乙方使用 二、租赁房屋概况及用途 1、24层共平方米待装修经营娱乐、餐饮 2、56层为标准间客房共间已装修好 3、78层由写字间改为客房待装修共间 4、位于上述楼房侧的招待所60间待装修改造做客房使用 三、房屋租赁期限 共年自年月日至年月 日 四、租金 1、租金共元 其中:56层租金元 78层(由甲方改造装修好)租金元 24层(由甲方装修好后)租金元 60间
2、招待所(由甲方实施旧楼改告后)租金元 2、租金支付方式: 乙方先支付已装修完毕的五、六层租金合同生效后20日内交第一季度租金 其它楼层一经装修完毕乙方即在20日内向甲方交纳该装修完毕楼层的租金 租金交纳:租金按季度交纳乙方应在每季度初的20日内向甲方交纳租金 五、押金 自合同签订之日起30日内乙方应向甲方支付元押金乙方未按时交纳租金甲方有权用押金冲抵乙方租金及违约金合同履行完毕租金结清甲方退还乙方押金 六、房屋转租 合同未经甲方同意乙方不得随意将该房屋转租给他人否则甲方有权解除合同 七、违约责任: 1、在经营期间乙方应爱护租赁财产因保管不善致租赁财产损坏的应恢复原状无法恢复的应赔偿甲方的损失
3、2、乙方应严格按合同约定日期交纳租金逾期应支付违约金违约金按季度租金总额的同期银行贷款利率计付 八、合同的解除: 乙方无正当理由未支付或者迟延支付租金的甲方可以要求乙方在合理期限内支付乙方拖欠房租累计6个月以上的甲方有权终止租赁合同 九、其它条款: 1、宾馆的营业执照由乙方办理并由乙方承担相关费用 2、宾馆名称由乙方确定合同履行期间乙方以自己的名义经营 3、乙方经营期间的债权、债务由乙方承担甲方不承担任何责任 十、争议解决办法: 在合同履行过程中发生争议双方应协商解决如协商不成可提交仲裁委仲裁 十一、本合同一式肆份甲、乙双方各执贰份四份合同举有同等法律效力 甲方:乙方: 年月日年月日 电话:电

9、heduleduringtheleasetermpartybwillpaytopartyaasadepositbefore(month)(day)(year).partyawillissueawrittenreceiptafterreceivingthedeposit. 2)unlessotherwiseprovidedforbythiscontractpartyawillreturnfullamountofthedepositwithoutinterestonthedaywhenthiscontractexpiresandpartybclearsthepremisesandhaspaidal
10、lduerentalandotherexpenses. 3)incasepartybbreachesthiscontractpartyahasrighttodeductthedefaultfinepensationfordamageoranyotherexpensesfromthedeposit.incasethedepositisnotsufficienttocoversuchitemspartybshouldpaytheinsufficiencywithintendaysafterreceivingthewrittennoticeofpaymentfrompartya. 4)ifparty
11、bcantnormallyusetheapartmentbecauseofpartyapartyashouldreturnthedeposittopartybatonce.andpartybhastherighttoaskforthepensationfrompartya. 6.obligationsofpartya 1)partyawillprovidethepremisesandattachedfacilities(seetheappendixoffurniturelistfordetail)onscheduletopartybforusing. 2)incasethepremiseand
12、attachedfacilitiesaredamagedbyqualityproblemsnaturaldamagesoraccidentspartyawillberesponsibletorepairandpaytherelevantexpenses.ifpartyacantrepairthedamagedfacilitiesintwoweekssothatpartybcantusethefacilitiesnormallypartybhastherighttoterminatethecontractandpartyamustreturnthedeposit. 3)partyawillgua
13、ranteetheleaserightofthepremises.incaseofoccurrenceofownershiptransferinwholeorinpartandotheraccidentsaffectingtherightofleasebypartyb.partyashallquarantcethatthenewownerandotherassociatedthirdpartiesshallbeboundbythetermsofthiscontract.otherwisepartyawillberesponsibletopensatepartybslosses. 4)party
14、amustregisterthiscontractwiththerelevantgovernmentauthorityifnotdoingsoresultingthatthiscontractisinvalidorpartybsrightofleasingmaybedamagedpartyashouldtaketheallresponsibilities.partyashouldalsobearthealltherelevanttaxes. 7.obligationsofpartyb 1)partybwillpaytherentalandthedepositon. 2)partybmayaddnewfacilitieswithpartyasapproval.whenthiscontractexpirespartybmaytakeawaytheaddedfacilitieswithoutchangingthegoodconditionsofthepremisesfornormaluse. 3)partybwillnottransfertheleaseofthepremisesorsubletitwithoutpartyasapprovalandshouldtakego
