保险单据（二） -保险单（Insurance Policy) 主要内容n一、保险单的缮制n二、保险单的背书转让n三、保险索赔 教学目标与要求n掌握保险单的缮制n了解保险单的背书转让n了解保险索赔的相关程序 一、保险单的缮制n保险人（NAME OF INSURANCE COMPANY）n 填写承保此批货物的保险公司的名称n通常各保险公司会在自己公司的保险单上印制好本公司抬头n实务中应根据信用证和合同要求到相应的保险公司办理保险n如信用证中规定“Insurance Policy/Certificate by PICC ”，则该保险单只能由中国人民保险公司出具 保险单据名称（Name /Title）n1.依照信用证和合同填写n2.《UCP600》规定：暂保单将不被接受-Cover notes will not be accepted. n3.《UCP600》规定：可以接受保险单代替保险证明书或预约保险项下的保险声明n--An insurance policy is acceptable in lieu of an insurance certificate or a declaration under an open cover. nInsurance Policy/ Certificate In TriplicatenInsurance Policy In Two Originals （一）发票号码（Invoice No. ） n填写同笔交易中的发票号。
（二）保险单号（ Policy No. ）n此处为保险公司提供的保险单号 （三）被保险人（Insured）n1.托收方式下，填写出口商n2.信用证支付方式下，按相关规定办理n（1）如果信用证或合同对于被保险人没有明确规定，填写信用证的受益人，也就是出口商的名称（无须注明地址）n（2）如信用证规定：n Insurance policy to order of xxx bank, Insurance policy in favor of yyy bank, 则在被保险人栏目填写： xxx（出口公司名称）held to order of xxx bank; xxx（出口公司名称）in favor of yyy bank 同时出口商要在保险单背面进行背书 n（3）如果信用证规定某一特定方为被保险人，则可以在此栏直接填写该指定方，同时出口商不用背书nInsurance policies or certificate, name of assured to be showed: ABC Co., Ltd. n（4）如信用证中关于保险单规定为：nEndorsed to the order of xxx bankn则在Insured 栏目，要填写出口商的名称n同时在保险单背面进行记名指示背书。
nSDUT PAY TO THE ORDER OF xxx BANK n（5）如果信用证中关于被保险人的规定为：to ordern 则在 Insured 栏目填写 to ordern 同时出口商要在保险单背面进行背书nDocuments required: Insurance Policy/Certificate to order and blank endorsed covering all risks, war risks as per Ocean Marine Cargo Clauses & Ocean Marine Cargo War Risks Clauses of The People’s Insurance Company of China dated 1/1/1981. n（6 ）如果信用证中关于保险的规定有： n Loss ,if any, pay to XXn则在Insured 栏目填写出口商的名称n出口商要在保单背面做空白背书n同时在保单claim payable at 栏目后加注 pay to XX n（7 ）FOB、CFR、FCA、CPT条件下，如进口商委托我出口商办理保险：n 在汇付、托收方式下： Insured栏目 填 出口商n 信用证支付方式下：填 xx on behalf of yy n 出口商进口商 n（8）若信用证中规定：： Documents required: Insurance Policy to order of whom it may concern covering marine transportation all risks ,war risks as per CIC clauses d.d. 1/1/1981n则Insured 栏目填写： to order of whom it may concern n出口商不用对保单进行背书。
n（9）国外来证规定：ninsurance policy or certificate for ten pct above CIF invoice value payable to the order of bank of Ceylonn？n在Insured 栏目，填写信用证受益人的名称n同时，信用证受益人要在保单背面加盖公司章作空白背书n最后，在保险单Claim payable at 栏目，填写 赔付地名 后再加注 payable to the order of bank of Ceylon （四）保险货物说明（Description of Goods））n1.与提单相同，填写货物的总称即可n2.一般还要加写最大包装件的加总数n3.如信用证或合同中有特殊要求，如在所有单据上注明信用证号码及开证日期与开证行，或加注合同号，则在此栏空白处作相应加注 （五）包装、单位及数量（（Packing Unit Quantity））n1.与提单相同，填写最大包装总件数及包装种类n2.裸装货物填写货物本身件数n3.散装货物填写货物净重n4.有包装但是以重量计价的应该同时填写总件数和计价总重量 （六）保险金额（Amount Insured）n1.按信用证或合同规定的金额及加成率填写。
n2.如无具体规定，则按CIF或CIP或发票金额加一成；n3.“进一取整”原则：与 均为USDn4.人保公司不接受保额超过发票总值30%的保单；n5.货币单位应与信用证的货币一致，至少按信用证要求的金额出具；n6.如发票已扣佣或扣折扣，按扣前的发票毛值投保 nDocuments required: Insurance Policy/ Certificate endorsed in blank covering marine transportation all risks, war risks as per O.M.C.C. of P.I.C.C. dated January 1,1981.nInformation of Invoice: ？？the minimum amount insured nDocuments Required: Insurance Policy/ Certificate Blank Endorsed For 110pct of Invoice Value Covering Marine Transportation clause (A) , war Risks As Per ICC(A)nInformation of invoicenTotal merchandise value:n USD110,000.00 ？ （七）承保险别（Conditions）n1.以“Covering……”开头。
n2.不仅要注明所投保的险别还要写明适用的文本及日期n3.常用保险条款及生效日期n ICC 1/1/1982n CIC 1/1/1981n4. 险别： 英国伦敦协会货物运输保险条款中国保险条款 ICC(C)F.P.A. ICC(B)W.P.A.(W.A.) ICC(A)ALL RISKS( A.R.)附加险（战争险、罢工险、恶意损害险）附加险（一般附加险、特殊附加险） 《中国保险条款》海上货运保险险别 基本险（主险） Basic Cover平安险（Free from Particular Average ,F.P.A ）水渍险（With Particular Average, W.P.A., ，W.A.）一切险(All Risks, A.R.)附加险Additional Cover一般附加险偷窃、提货不着险(Risk of Theft, Pilferage and Non-delivery, T.P.N.D.)淡水雨淋险(Risk of Fresh Water and Rain Damage)渗漏险(Risk of Leakage)短量险(Risk of Shortage)受潮受热险(Risk of Sweating and Heating Damage)混杂玷污险(Risk of Intermixture and Contamination)碰损破碎险(Risk of Clash and Breakage)钩损险(Risk of Hook Damage)锈损险(Risk of Rust)串味险(Taint of Odor Risk)包装破损险(Breakage of Packing Risk)特殊附加险战争险(War Risks)罢工险(Strikes Risks)交货不到险(Failure to Delivery Risk)舱面险(On Deck Risk)黄曲霉素险（aflatoxin Risk)拒收险(Rejection Risk)进口关税险(Import Duty Risk) n按照中国人民保险公司1981年1月1日海运货物保险条款和海运货物战争险条款承保一切险和战争险。
n（1）Covering All Risks and War Risks as per Ocean Marine Cargo Clauses & Ocean Marine Cargo War Risks Clauses of The People’s Insurance Company of China dated 1/1/1981. n（2）Covering Marine Risks Clause (A) as per Institute Cargo Clause (A) dated 1/1/1982.n按照伦敦协会1982年1月1日货物A条款承保海运险A条款n在实际业务中可采用缩略形式：PICC; CIC; dd; ICC; &; OMCC等 n5.出口公司只需要在副本上填写n6.应该严格按照信用证规定的险别来填写n7.如果信用证规定的险别超出了合同规定，那么出口商可以拒绝，然后要求进口商改证；或者先和进口商商定，如果多出的保险费买方另行支付，那么出口商可以接受，然后按照信用证规定的险别去投保 （八）货物标记（Marks of Goods）n1.与提单相同，填写唛头或者写“as per invoice no. XXX”n2.但是信用证规定所有单据必须显示唛头的则必须按照实际唛头填写。
（九）总保险金额 (Total Amount Insured: ）n填写大写保险金额: 计价货币的大写+ 数值的大写+only （十）保费（Premium）n1.保险公司一般在印刷的保险单上填入“as arranged”，，无需填写n2. 但信用证另有规定者除外，如nInsurance policy endorsed in blank for full invoice value plus 10% marked premium paidn此时要把已经印好的 as arranged 删去，加盖校对章后打上paid （十一）装载工具 （per conveyance S.S.）n1.填写运输工具名称n2.如为海运，则根据配舱回单填装运船的船名如果是两程运输完成时，要分别填写一程船名和二程船名n例如：Dawnstar/ Flyingcloud （十二）开航日期 （ Slg. On or abt. ）n1.一般填写提单的签发日期n2.也可填提单签发日前后5天之内的任何一天的日期n3.也可直接填写 AS PER B/L （十三）装运港（From……）n《UCP600》规定: 保险单据须表明承保的风险区间至少涵盖从信用证规定的货物接管地或发运地开始到卸货地或最终目的地为止。
niii. The insurance document must indicate that risks are covered at least between the place of taking in charge or shipment and the place of discharge or final destination as stated in the credit. （十四）目的港（to……）n1.不需要转运的货物，则直接填写目的港n2.如果货物是经转船到达目的港的，则填写“目的港+W/T（VIA）转运港”n3.如果到达目的港之后须转运内陆某地买方仓库，例如到达目的港西雅图之后转运芝加哥，保险单目的港可填写 Seattle AND THENCE TO CHICAGO” （十五）保险单的份数n1.若保险单表明有多份正本，全部提交n2.如信用证没有特别说明保单份数，出口公司一般提交一套完整的保险单（一份正本“original”,一份复联“duplicate”）n3.中国人民保险公司出具的保险单一套五份，由一份正本“original”、一份复联“duplicate”与三份副本“copy”构成。
n4.当来证要求： Insurance policies or certificate in two fold /in duplicate/in 2 copiesn制单结汇时应提交一份正本“original”,一份复联“duplicate”n5.注意保单份数需要在两处进行填写 （十六）赔款偿付地点（claim payable at……）n1.如来证无特别规定，一般将目的地作为赔付地点，一般填写目的港的名称n2.但是信用证有明确规定时，严格按照信用证的规定填写（即使信用证将目的国作为赔付地，也应该如实填写目的国）n3.有的情况下，须在填写完该栏后，按照要求 填写 payable to xxxx n4.4.此栏还应加注赔款支付币种，用In 作引导词，所用币种一般为与投保额相同的币种n5.如信用证要求注明理赔代理人，则在此栏上方空白处注明相应代理人 nInsurance policies or certificate in two fold issued to the applicant, covering risks as per institute cargo clauses (A), and institute war clauses (cargo) including warehouse to warehouse clause up to final destination at Schorndorf for at least 110% of CIF value, marked premium paid showing claims if any payable in Germany, naming settling agent in Germany. （十七）日期（Date……）n1.填写保险单的签发日期。
n2.根据W/W条款，保险手续应该在货物离开出口方仓库前办理因此保险单的日期应该是货物离开出口商仓库前的日期n3.《UCP600》明确规定：保险单据的日期不得晚于装运日期，除非保险单据表明保险责任不迟于装运日生效ne. The date of the insurance document must be no later than the date of shipment, unless it appears from the insurance document that the cover is effective from a date not later than the date of shipment. （十八）投保地点（（at……））n填写投保地点名称，一般填写装运港的名称 （十九）保险人签字盖章n1.加盖保险公司的公章并由保险公司授权签字人签字n2.根据英国法律规定，海上保险公司出具的保险单可只盖图章n3.《UCP600》规定：保险单据，例如保险单，保险凭证或预约保险项下的保险声明，必须看似由保险公司或承保人或其代理人或代表出具并签署如果保险单据表明其以多份正本出具，则所有正本均须提交。
《UCP600》nArticle 28 Insurance Document and Coverage na. An insurance document, such as an insurance policy, an insurance certificate or a declaration under an open cover, must appear to be issued and signed by an insurance company, an underwriter or their agents or their proxies. nAny signature by an agent or proxy must indicate whether the agent or proxy has signed for or on behalf of the insurance company or underwriter. nb. When the insurance document indicates that it has been issued in more than one original, all originals must be presented. 二、保险单的背书 （一）空白背书n1.在保险单的背面注明出口公司的名称和经办人的名字即可。
n2.如来证没有规定使用哪种背书方式，默示规定为空白背书方式 （二）记名背书n1.如来证规定：n则在保险单背面盖上出口公司的章以及注明经办人的名字后，根据信用证的要求，填写n记名背的后手不可再背书转让nInsurance policy delivered to Citibank, New York;nInsurance policy/certificate endorsed in the name of xxx Co., Ltd.nDelivery to Citibank, New York；nin the name of xxx Co., Ltd. （三）记名指示背书n1.1.当信用证规定：n则在保险单的背面注明““to the order of xxx””，，然后盖上出口公司的章nInsurance policy or certificate is negotiable for issued to the order of xxx （四）背书的特殊情况n1.当出口商代进口商投保，并且保险单上的被保险人是进口商，那么出口商不能背书，如需转让保单，只能由进口商背书n2.当被保险人为第三方时，该保险单不用背书即可转让。
信用证中保险单条款举例：nInsurance policies or certificate, name of assured to be showed: ABC Co., Ltd. nInsurance policies or certificate in two fold payable to the order of Commercial Bank of Ceylon Ltd., covering marine institute cargo clauses A(1.1.1982), Institute strike clauses cargo (1.1.1982) Institute war clauses cargo(1.1.1982) for CIF invoice value plus 10%. nInsurance Policy/Certificate endorsed in blank for 110% of invoice value covering All Risks & War Risks as per CIC with claims payable at KUALA LUMPUR in the currency of draft (irrespective of percentage), including 60 days after discharge of the goods at port of destination subject to CIC. nMarine insurance policy or certificate in duplicate, endorsed in blank, for full invoice value plus 10 percent stating claim payable at Thailand covering FPA as per ocean cargo clause of the People’s Insurance Company of China dated 1/1/1981, including TPND，loss and/or damage caused by heat, ship’s sweat and odor, hoop-rust, breakage of packing. 三、保险索赔n1.收货方发现货损后，应及时通知保险公司在目的港的代理人勘查现场，并请第三方检验机构进行检验，同时要求承运人或货代公司签发损坏货物证明或短装记录或货物残损清单；若是集装箱破损，应要求理货公司出具损失/破损报告副本，并采取保留破损的铅封等相应措施。
n2.保险公司勘查代理人出具检验报告，收货方提交索赔单证，勘查代理人把相关材料发回到国内保险公司n3.国内的保险公司进行理赔 小结n1.如果来证无其他规定，保险单的被保险人应该是信用证上的受益人，并用空白背书形式n2.保险险别和保险金额要与来证的规定相符保险单上的运输标志、包装及数量、货名、船名、大约开航日期、装运港和目的港等要与提单一致n3.保险单的签发日期不能晚于提单日期n4.不能使用保险经纪人开出的暂保单代替保险单去银行议付，银行是不会接受的。
