4、“促进社会和谐稳定”这一立法目的的最佳途径之一。本文主要对大规模侵权及赔偿基金制度进行阐述。首先，从典型大规模侵权案件入手，对大规模侵权的定义、性质以及发生的原因进行详细的研究和探讨。其次，通过对赔偿基金的理论分析，论证构建大规模侵权赔偿基金制度的必要性，找出赔偿基金与其他救济手段的差异，结合发达国家对于赔偿基金的运用，分析优劣、实施的实际效益以及在我国实施的可行性的探讨，发现其中对于我国大规模侵权赔偿基金制度构建有益的、可行的措施和相关措施的理论依据。最后，从赔偿基金的设立机制、运作机制及赔付标准等角度提出方案构想，以期望能够对统一赔偿基金在大规模侵权中的实际运用。关键词：大规模侵权；赔偿基

The mass tort becomes a hot legal issue in tort as the seriousness of injure, the extensive of the scope, the
6、 variety of the involved area and the damage to endanger the social stability after injure. At present, our country law scholars for the mass tort problem tend to build a diversified relief system, which includes law and social remedy way, the substantive and procedural laws combined with comprehens
7、ive relief mechanism. Through the establishment of mass tort multiple relief system to resolve the related disputes, is one of the best ways of the legislation purpose that to realize the tort liability law to promote social harmony and stability.This paper mainly elaborates mass tort and compensati
8、on fund system.Firstly，through the analysis of the typical case of mass tort, to study and discussion the definition of mass tort, the characteristics, and occurs reasons carefully. Secondly, based on the theoretical analysis of the compensation fund, construct the necessity of mass tort compensatio
9、n fund system,find out the differences between compensation fund and other relief methods, combined with the developed countries for the use of the compensation fund, analysis the pros and cons, practical benefits of the implementation and to explore the feasibility of implementation in China, found
10、 the useful and feasible measures and relevant theory to build Chinas mass tort compensation fund system . Finally, the scheme idea from the establishment mechanism of compensation fund, operation mechanism and compensation standards perspective, in hope of making use of unified compensation fund in
