2、compliance with (The Contract Law of the Peoples Republic of China) and ( Shanghai Tenancy Agreement) (herein as Agreement), this Agreement is made, through consultation on the basis of equality, voluntaries and mutual benefit, by and between Party A and Party B, whereby Party A agrees to let the le

3、gally possessed real estate to Party B and Party B agrees to take the same from Party A on the following terms and conditions.一、 出租或预租房屋情况 One. The Situation of Leasing or pre-leasing Premises.11. 甲方 出租 (出租/预租)给乙方的房屋坐落在本市XX区 XX 路XX号X号楼 X 室(以下简称该房屋)。该房屋 实测 (【出租】实测/【预租】预测)建筑面积为 120 平方米,房屋用途为 住宅 ,房屋类型为

4、 公寓 、结构为 混合一等 。甲方已向乙方出示:1-1. Party A shall let to Party B: Unit XX Block X The Edifice, Shanghai, which is the legal possession of Party A (hereinafter referred to as the Premises). The floor area of the Premises Party A shall let to Party B is 120 square meters in all (Lease/ Actual). The Premises

5、use is Residence, the type of the Premises is Apartment, and the structure is Reinforced Concrete. The plot of the Premises sees the attachment (一). Party A shall show to Party B the following item:1) 【出租】房地产权证/房屋所有权证/ ;证书编号:沪房地浦字( 2000 )第 0148XXX 号。1) The certificate of real estate ownership, the r

6、egistered number is 沪房地浦字( 2000 )第 014XXX号,12. 甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 未 (已/未)设定抵押。 1-2.Party A shall set up Tenancy Agreement with Party B as the ownership rights to realty (1.ownership rights to realty 2.bailee 3. other rights to realty by the law of the

Party A shall notify Party B about mortgage (Y/N) before signing the Tenancy Agreement.13. 该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。甲方可以接受正常的磨损。 1-3.The usage area, condition, requirement of com

8、mon space or share occupancy of the Premises, condition of facilities, the associated amenities required by Party B based on the agreement of Party A shall be specified in the attachment to this Agreement by the parties hereto. Such attachment shall serve as the basis upon which Party A shall hand o

9、ver the Premises to Party B as described in this Agreement, and shall inspect and accept the Premises when Party B hands back such the Premises upon the expiration of the Agreement. Fair wear and tear of the Premises is acceptable by Party A.二、 租赁用途Two. Usage of the Premise21. 乙方向甲方承诺,租赁该房屋仅作为 住宅 使用

10、,并遵守国家和本市有关房屋使用和物业管理的规定。 2-1.Party B promises to Party A to use the Premises solely for the purpose of Residence, and shall be abided by the related principle of local and the Peoples Republic of China.22. 乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批而未核准前,不擅自改变上述约定的使用用途。 2-2.Within the term of this Agreement, P

11、arty B shall not use the Premises for any other purpose without obtaining the prior written consent of Party A and the confirmation and approval of the department concerned.三、 交付日期和租赁期限 Three.Delivery date and leasing term31. 甲乙双方约定,甲方于 200X 年 06 月 XX 日前向乙方交付该房屋。【出租】房屋租赁期自 200X 年 06 月 XX 日起至 200X 年0

12、X 月 XX 日止。3-1. The term of this Agreement is XX months in all, commencing on June XX, 200X, and expiring on June XX, 200X.32. 租赁期满,甲方有权收回全部出租房屋,乙方应如期返还。乙方需继续承租该房屋的,那么应于租赁期届满前 X 个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。 3-2.Party A shall be entitled, upon expiration of this Agreement, to claim back the Premises

13、 and Party B shall have to hand back the same in time as stipulated. In case that Party B wishes to renew this Agreement upon expiration of this Agreement, Party B shall notify Party A in X month before the expiration of this Agreement. A new Agreement shall be signed after Party A expresses its agr

14、eement.四、 租金、支付方式和期限 Four.Rent, Payment Method and Term 41. 甲、乙双方约定,该房屋【出租】月租金总计为( 人民币) 1XXXX 元。大写:壹万XXXX整, 包含物业管理费,XXXX。4-1.Upon the agreement between Party A and Party B, the monthly rent of the Premises totals RMB 1XXXX .including the management fee, XXX 42. 乙方应于每月 XX 日前向甲支付租金。4-2.Party B shall p

15、ay monthly rent to Party A in advance on the XXth day of each calendar month. 43. 乙方支付租金的方式如下: 银行转账, 甲方账户信息见补充条款 。4-3.The method of payment of the rent for the Premises is as follows: Bank Transfer. Party As bank account information states in the additional terms.五、 保证金和其他费用 Five. Security Deposit and other Fees51. 甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为 X 个月的租金,即( 人民币 ) XXXX 元。甲方收取保证金后向乙方开具收款凭证。租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承当的费用外(水电煤, 等),剩余局部无息归还乙方。 5-1.Upon the mu
