2、isofequality,freewillandmutualconsultation.一、工作内容ArticleOneWorkingContents1.1甲方因生产需要，赞同聘任乙方为本企业员工，职位为乙方赞同接受该安排，恪守劳动纪律和职业道德，执行劳动安全规程，提升职业技术，达成生产（工作）任务。Tomeettheproductiondemand,PartyAagreestoemployPartyBasagreestoacceptthearrangement,observethelabordisciplinecarryoutrulesofsafeoperation,improveprofes
3、sionalproductiontasks.PartyBandprofessionalethics,skillsandaccomplishes1.2甲方可依据生产经营需要依法调整乙方的工作岗位或职位。PartyAmaylegitimatelyadjustPartyBspostaccordingtobusinessrequirements.a二、合同限期ArticleTwoTermofContract本合同自年月日至年月日，。劳动合同的限期届满或商定的停止条件出现，劳动合同即停止执行。经两方磋商一致的，能够排除或续订劳动合同。Thiscontractwillbeeffectfrom(date,m

5、stdays(maybetheyarenotSaturday,Sunday).3.2甲方因工作需要，在乙方愿意的前提下，可依法安排乙方超时工作或公休日加班。PartyAmaylegitimatearrangePartyBtoworkovertimeorworkongeneralholidaysduetobusinessrequirementsonconditionthatPartyBiswillingtodoso.3.3甲方因为工作需要改正工时制度，经政府相关部门赞同后，乙方应亲密配合执行。PartyAmaychangeworkinghourssystemforbusinessrequirem
6、entafterapprovalbyrelevantgovernmentauthoritiesandPartyBshallexecuteitofhisownwill.四、薪酬ArticleFourRemuneration4.1甲方支付乙方的每个月基本薪水为人民币元。上述薪酬不包含甲方按企业补贴规定按月向乙方支付的全部补贴。PartyApaystoPartyBasbasicwagepermonth.TheaforesaidremunerationexcludesallsubsidiespaidtoPartyBpursuanttoPartyAsstipulation.4.2甲方严格执行国家相关最低
7、薪水的规定和标准。PartyAshallstrictlyimplementrelevantregulationsandstandardperthelowestwage.4.3甲方的发薪日期为每个月日。PartyAshallpaythewageonthedayeverymonth.五、劳动保护与劳动条件ArticleFiveLaborProtectionandLaborConditions5.1甲方须对乙方进行劳动安全、业务技术及劳动纪律等方面的教育和培训，并依据国家对劳动保护、安全生产的要求，为乙方供给必需的生产（工作）条件，保障乙方的安全健康。PartyAshallgivePartyBedu
8、cationandtrainingprogramsrelatingtolaborsafety,professionalskillsandlabordisciplinesetc.Accordingtotherequirementsofstatelaborprotectionandsafe-production,PartyAshallprovidenecessaryworkingconditiontoensurePartyBssafetyandhealth.六、社会保险和福利ArticleSixSocialInsuranceandWelfare6.1甲方依法替乙方办理各项社会保险并缴纳保险花费。但
9、依法例定之分摊比率，属于乙方须自行负担之各项社会保险金，由甲方于每个月发薪时，从乙方薪水中代扣代缴。PartyAshalltransactsocialinsuranceandpaythemforPartyB.PartyAshallwithholdthesocialsecuritycontributionlegallyundertookbyPartyBwhenpayingtheremunerationeverymonth.6.2乙方享有国家规定的全部法定假日。PartyBwilltakeallstatutoryholidaysstipulatedbytheState.6.3甲方推行年休假制度，乙
10、方连续工作满一年以上的可享受有薪年假，申请享受方法按甲方拟订的年假规定执行。PartyAcarriesoutannualvocationsystem,PartyBcantakepaidannualvocationaftercontinuouslyworkingfor1yearandtheapplyingprocedureforannualvocationshallbedonepursuanttoPartyAsstipulation.3七、乙方责任ArticleSevenPartyBsResponsibility7.1乙方一定仔细工作和劳动，保质保量地达成自己的生产任务。PartyBmustwo
11、rkearnestlyandaccomplishitsowntaskswithqualityandquantity.7.2乙方一定照实报告工作，踊跃配合和辅助上司的工作。PartyBmustreportitsjobaccordingtothefactsandshallcooperatewithitsuppersandassisttheirjobs.7.3乙方应严格执行甲方依法拟订的规章制度和员工手册。PartyBshallstrictlyimplementtherulesandregulationsandHandbooklegallystipulatedbyPartyA.7.4乙方应爱惜甲方的
12、财物，对因为自己责任造成的直接经济损失，一定予以赔偿并接受甲方的处分。PartyBshalltakegoodcareofPartyAspropertyandhe/shemustindemnifydirectdamageduetohis/herliabilityandacceptsPartyAspunishment.7.5乙方在劳动合同有效期内未经甲方预先书面赞同，不得为另一家雇主工作。PartyBcannotworkforanotheremployerwithoutPartyAswrittenconsentinthedurationofLaborContract.7.6乙方应严格守旧甲方的商业
13、奥密，不得向任何第三方泄漏。PartyBshallstrictlykeepPartyAstradesecretandcannotdivulgetoanythirdparty7.7照实陈说简历和学历。PartyBshallstatehis/hercurriculumvitaeandeducationalbackgroundaccordingtothefacts.7.8如甲方委派乙方培训（包含国外培训），乙方一定恪守甲方的培训条规和承诺。PartyBshallobservePartyAstrainingrulesandundertakingwhenPartyAassignsPartyBtobetr
14、ained.八、甲方无偿排除合同ArticleEightCancellationoftheContractwithoutCompensationbyPartyA若切合以下状况之一的，甲方能够随时排除合同，而不用赐予乙方任何经济赔偿：PartyAmaycanceltheContractatanytimewithoutcompensationtoPartyBunderthefollowingcircumstances:8.1当乙方在试用期内不切合甲方的员工录取条件，甲方不必赐予乙方排除的原由。WhenPartyBisproventobeunqualifiedforPartyAsemploymentconditionsduringproba
