11、l玻璃幕墙、钢结构、网架施工分包合同发包方：（以下简称甲方）承包方： 身份证号：(以下简称乙方）依照中华人民共和国合同法、中华人民共和国建筑法及其台州市有关法律法规，遵循平等、自愿、公平和诚实信用的原则,甲乙双方就临海监狱工程五标、七标工地的玻璃幕墙、钢结构、网架工程施工有关事项达成一致意见，订立本合同。一、工程概况1工程名称：浙江省临海监狱2工程地点：临海市大洋街道狮云村二、工程范围及承包形式1、工程范围：玻璃幕墙工程、钢结构、网架(包括:相关工程的设计、供料、加工、预埋安装、竣工验收资料等。）2、承包形式：本工程为综合单价承包合同,合同综合单价属于包干性质，（包括人工费、材料费、措施费、规
12、费、现场经费、利润等)。三、合同工期1本工程开工日期自合同签订之日起至竣工日期为天。2、如遇不可抗力因素给乙方造成的停工、误工，应给予乙方工期顺延。3、除不可抗力因素外，所有其他原因引起的工期延误，不予给予顺延。四、质量及验收标准执行国家现行施工验收规范、建筑安装工程质量检验评定标准验收的合格等级和甲方要求的技术指标严格施工，一次性验收合格,附乙方向甲方提供质量保证书,保证玻璃幕墙的施工符合设计及计算要求，确保工程质量达到国家规定的“合格标准”，争创优良工程.五、合同价款1、合同单价:玻璃幕墙 660 元/ ，钢结构450元/，网架 1300元/（此单价包括人工费、材料费、措施费、规费、现场经
13、费、利润、玻璃幕墙设计费和三性检测费等。)六、付款方式：进场施工当月的20日前报工程量单请款，甲方于次月10日前按乙方上期已完工程量的%付款。乙方工程全部完工退场一次性结付总工程款的%，退场2个月内结付总工程款的，总款5作为工程质量保证金，于质保期满2年后扣除维修费无息退七、质保约定 质保期两年(竣工验收合格之日起）。八、双方责任1、甲方责任: 1)提供施工用水、用电（含水电费)(施工水管、电线乙方自备)。 2）组织有关单位与乙方的协调会。 3） 在乙方递交工程竣工书面报告后，组织有关部门进行玻璃幕墙验收。 2、乙方责任： 1）对幕墙、钢结构、网架等进行设计（注：如甲方已有图纸不需另设计)，经
14、具有相关设计资质的设计单位签准及甲方审核确认后方可使用，保证设计符合国家有关规范要求,对设计质量负责，承担因设计质量问题引起的一切后果,并向甲方提交幕墙设计图纸及计算书陆套。 2)严格按照批准的设计图纸施工，服从甲方驻工地代表及工程监理的监督管理，发现问题及时纠正，对工程质量负责，承担因工程质量问题引起的一切后果。 3）编制施工组织设计和工期进度计划，并经甲方审核通过. 4）负责所有进场材料的保管及未验收前的成品保护，保护期间发生损坏，乙方原因乙方自费修复，非乙方原因损坏,由责任方负责修复，或乙方修复由甲方承担追加合同价款。 5)提供完整的竣工验收资料给甲方，保证验收通过，如因乙方资料或其他原
15、因，致使工程未能按时通过验收，由此给造成的一切损失由乙方承担。 九、安全、文明施工1、工程安全:乙方必须按国家有关安全规范标准及甲方和监理的交底要求进行施工，接受甲方和监理的检查、处罚和整改要求,消除安全隐患。施工中发生的一切安全事故，均由乙方负全部责任并承担全部费用，甲方不负任何连带责任。2、文明施工：乙方必须按台州市文明施工标准及甲方有关规定要求进行施工，达到台州市施工现场标准，否则甲方将出工协助清理施工现场，其费用将从乙方的工程款中扣除.十、违约责任1、 如乙方不按合同规定时间进场、不按甲方要求的人数到场，甲方有权单方解除本合同；2、 乙方在施工中未能在质量、安全、进度、现场文明和节约材
16、料等方面等达到甲方要求的，甲方有权要求乙方进行整改,如整改后仍不符要求，甲方有权采取针对措施（包括要求支付违约金或组织其他班组进场施工），直至单方解除本合同,乙方不得无理取闹或阻拦，影响甲方工程施工;3、 乙方材料由乙方自行负责保管，发生丢失概与甲方无关；4、 乙方须节约材料,超出部分由乙方自负;5、 如乙方因自身缘故不能按照甲方要求完成工程进度，每延迟一天，乙方必须向甲方支付乙方承包工程总额0。1的违约金;经甲方要求后，如在三天内仍无法完成进度，甲方有权终止本合同，对乙方进行退场处理，工程款按乙方实际已完工作量50%进行结算.6、 如乙方工程质量达不到合格等级，乙方必须在甲方规定时间内无条件返工，否则甲方有权终止本合同；7、 乙方不听从
