1、我国西部农村土地问题的法学思考摘 要实施西部大开发战略，加快西部发展，逐步缩小各地区之间的发展差距，实现区域经济协调发展，最终达到各地区经济普遍繁荣和全体人民共同富裕，既是社会主义本质特征要求，亦是国民经济持续协调发展的内在需要。近年来，虽然西部大开发已经取得了举世瞩目的成就，但是其中暴露了不少的问题。尤其是土地问题。本文就是针对这种情况，对西部农村土地问题进行了研究。首先通过实地调查和参看有关资料，发现西部农村中普遍存在着耕地破坏与土地撂荒的情况严重、农村土地流转不合理、非法占地批地现象严重、征地程序不合理等问题；然后通过对西部农村土地普遍性的问题进行研究，着重从农村村民文化素质不高，法律意
2、识淡薄、农村土地流转制度不完善、法律不完善让土地违法行为有机可乘、经济利益驱动令土地违法行为肆意滋生、征地程序的不规范这几个方面分析了造成西部农村土地问题现状的原因；最后针对分析所得出的原因，提出相应的对策，指出要使西部农村土地问题得到有效的解决，就需要完善农村土地流转法律制度，完善征地法律制度、加强法治宣传，提高农民的法律意识、相关责任主体执法必严、违法必究，最终使土地问题得到有效的解决。关键字：西部农村，土地问题，土地流转，征地制度 ABSTTACTImplementing the western development strategy,accelerate the developmen

In recent years developing the western region has made remarkable achievements, but which exposed a number of issues, in particular the question of land. In this paper, the situation in the western rural land issues have been studied. First thr
5、ough field investigations and reading the relevant information, the following issues prevalent in the rural west have been found: destruction of cultivated land and land trimmer coming in serious condition, rural land transfers unreasonable, illegal occupation and approval of land are serious, the l
6、and requisition procedure unreasonable. Then through studying the universal issue of western rural land, especially focusing on rural villagers cultural quality is not high and lack of legal awareness, rural land transfer system flawing, imperfect land law giving opportunity to land offence, economi
7、c interests driveing land offence recklessly breeding, the land requisition procedure was not being standardized,we analysis the reasons for the status quo of the west rural land issue. Finally, corresponding countermeasures has been proposed based on the outcome reasons after analysising. To let th
8、e west rural land issues have been an effective solution, we need to improve the rural land transfer system and the land requisition system. And land offence must be managed strengthen. Strengthen the rule of law publicity to improving farmers awareness of the law. The relevant main responsibility e

12、坚持依法行政和加大执法监察力度.16结论.18参考文献.19致谢.20绪 论土地问题历来是农民问题的核心，当前“三农问题”和建设社会主义新农村也必须首先建立在土地问题解决的基础上。自国家确立西部大开发的发展战略以来，西部农村土地就为西部大开发做着积极的贡献。虽然西部土地资源人均占有量高于全国平均水平，但障碍因素和难利用土地较多，土地生产能力和承载能力低。西部本身多贫困地区，农民收入普遍较低问题、农业剩余劳动力转移问题、失地农民问题、城镇化建设问题等等无不涉及到土地，而西部农村却存在着诸如耕地破坏与土地撂荒情况严重、农村土地流转不合理、非法占地批地现象严重、征地程序不合理等一系列亟待解决的土地问题，这些问题严重影响了三农问题的解决，影响了新农村建设的步伐。要解决西部农村土地问题，就必须完善农村土地流转法律制度，完善征
