2、een the following Employer and Employee inaccordance with the Labour Law of Peoples Republic of China. 一、劳动合同期限Term of the Contract:第一条本合同期限类型为固定期限劳动合同双方合同期为年,即从 _年_月_日起至 _年_月_日止,其中,从 _年_月_日起至 _年 _月_日为试用期,试用期为个月。在试用期内,乙方被证明不符合录用条件的,甲方有权随时解除劳动合同。The term of this contract shall mence on _, and shall c

4、; 六An Employer may terminate an employment contract during the probation period if(1) Is proved not to satisfy the conditions for employment during the probation period;(2) Materially breaches the Employer rsquo;s rules and regulations;(3) mits serious dereliction of duty or practices graft, causing

5、 substantial damage to the Employer;(4) has additionally established an employment relationship with another Employer which materially affects the pletion of his tasks with the first-mentioned Employer, or he refuses to rectify the matter after the same is brought to his attention by the Employer;(5

6、) causes the employment contract to be invalid due to the circumstance specified in item(6)二、工作内容Job Description:第二条乙方同意根据甲方工作需要,承当以下职责_The Employer agrees to employ Mr./Ms._(name) as _(job title) in _Department第三条甲方有权根据公司开展的需要对乙方的工作内容进展变更Part A may change Part B“s position according to thedevelopme

9、alary, or it means that Part B agrees with that. 。Part B should to raise an objection in three days第六条甲方根据公司的经营效益和乙方的个人表现和业绩发放奖金,奖金的数额没有明确的规定,完全根据甲方效益和乙方绩效来确定。Part A may pay bonus according to the performance of Part B四、劳动合同的变更、解除、终止、续订Termination, Modification, Renew and Discharge of the Contract第八

10、条订立本合同所根据的客观情况发生重大变化,致使本合同无法履行的,经甲乙双方协商同意,可以变更本合同的相关内容。Due to the force majeure, The relevant clauses of the Contract may be modified by the parties.第十条经甲乙双方协商一致,本合同可以解除。The contract can be modified or terminated by the partiesthroughconsultation;第十一条乙方有以下情形之一的,甲方有权解除劳动合同并无须给乙方任何经济补偿金:一严重违背公司员工手册、人力

11、资管理制度、行政管理制度、岗位职责规定、上司任务安排等一系列公司规章制度的; 二三四五严重渎职,营私舞弊,给甲方利益造成重大损害的; 被依法追究弄事责任的; 乙方同时在其他地方兼职或以任何形式,对甲方的工作任务造成严重影响,或者经过甲方提出后仍不改正。在试用期被证明不录用条件的; 六乙方被发现其存在虚假欺骗行为包括但不限于其假工作经历、假学历证、假身份证明等,使甲方违犯真实意思的情况下与乙方订立合同的;The Contract may be discharged by the Employer with immediate effect and the Employee will not be

12、 pensated if the employee :(1Materially breaches the Employer”s rules and regulations ;(2) mits serious dereliction of duty or practices graft, causing substantial damage to the Employer;(3) has additionally established an employment relationship with another Employer which materially affectsthe ple

13、tion of his tasks with the first-mentioned Employer, or he refuses to rectify the matter after the same is brought to his attention by the Employer(4)The Employee is being charged with criminal offences:第十二条有以下情况之一的,甲方提早三十天以书面形式通知乙方本人或者额外支付乙方一个月工资后,可以解除劳动合同:一乙方患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事单位另行安排的

14、工作的; 二乙方不能到达所担任岗位的绩效指标或者相应的要求的,经过培训或者调整工作岗位,仍不能到达的; 三劳动合同订立时所根据的客观情况发生重大变化,致使劳动合同无法履行,经甲乙双方协商,未能就变更劳动合同内容达成协议的。An Employer may termi nate an employment contractby givingtheEmployee himself30 daysrsquo; priorwrittennotice,or one month rsquo;s wage in lieu of notice, if:(1) after the set period of medical care for an illness or non-work-related injury, the Employee canengage neitherin his original work nor in other work arranged for him by his Employer;(2) The Employee is inpetent and remains inpetent after training or adjustment of his position; or(3) A major change in the object
