2、文作者签名： 年 月 日 导师签名： 年 月 日 I 摘 要 家族信托是指以家族财富的传承为主要目标，以家族财产为信托财产设立的信托。家族信托从其本质上来说是信托的一种，以信托法律的基本规定为其提供规制，需遵守信托相关法律关于信托关系当事人、信托财产的规定。家族信托是信托制度在财富规划与管理领域的延伸应用。 信托制度产生与英美法系，在我国的发展历史较为短暂，信托的财富规划与财富管理功能在中国并没有得到充分的发挥。但在 2013年，由于市场的需求出现，中国首次出现了由银行等金融机构推出的家族信托业务。家族信托业务的开展走在了家族信托相关法律规定的前面。为了完善中国家族信托相关的法律理论及法律规定
3、，本文研究生了英美法系下与家族信托业务相关的信托具体制度，以期规范中国新兴的家族信托业务，进而促进家族信托业务不断发展壮大，防止潜在的法律风险。 首先，文章介绍了家族信托的基本概念及理论基础，对家族信托进行了宏观上的概括性描述，为下文具体论述英美信托制度奠定基础。其次，在对家族信托制度进行宏观论述的基础上，具体分析了家族信托所具有的不同于其他信托业务的具体的特点，并且深入分析了家族信托在财富管理和财富传承方面所具有的功能及其相对于其他法律制度所具有的优势。论证了在我国建立完善的家族信托制度的必要性。再次，在家族信托关系当中，各当事人的法律地位，权利义务关系等内容，是家族信托制度中最重要的内容，
4、通过对英美法系下信托关系当事人的权利义务关系的分析，为中国的家族信托制度提供了非常有益的借鉴。最后，在深入对比研究中国现存的信托相关法律制度与欧美信托制度后，得出了我国在发展家族信托业务方面所存在的主要的法律障碍，同时，结合我国经济社会发展的实际情况及法制的现状，为在中国实现家族信托健康、快速发展的目标提出了几点法律制度方面的建议。 关键词：信托制度，家族信托，信托登记，信托税务 II Abstract Family trusts refer to a specific kind of trust, the main objective of which is inheritance of f
5、amily wealth and it normally use family property as trust property. Family trusts, as a kind of trust, shall be govern by trust law and related laws and regulations. Family trusts reflect the extended use of trust law in the field of wealth planning and management. Trust law originated from common l
6、aw system, it has a relatively short history of development in China, its advantages in wealth planning and management has not been fully exploited. In 2013, family trusts emerged in China for the first time due to market development, but Chinas laws related to family trusts are lag behind the devel

Therefore, for the perfection of Chinas law related to family trusts and to avoid potential risk, this article studied the law related to family trusts in common law system, so that Chinas newly developed family trusts can make progress continually under appropriate govern.
