2、or (Party A): 承租方(乙方): Lessee (Party B): 依据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例)的规定,甲、乙双方在同等、自愿、公允和诚恳信用的基础上,经协商一样,就乙方承租甲方可依 出租 (出租)的 商品房 (房屋/商品房)事宜,订立本合同。In accordance with the Laws of Contract of the Peoples Republic of China and the Tenancy Regulations of the Shanghai Municipality (hereinafter referred to

3、 as “the Provisions”), Party A and Party B, having reached an agreement based on the principles of equality, willingness and mutual benefit, hereby enter into this Contract on matters in relation to the Lease of the Property by Party A to Party B.一、出租房屋状况Condition of the Lease or Pre-Lease Property1

4、-1甲方 出租 (出租)给乙方的房屋座落在本市 (区/县) 路 . (弄/新村) (号/幢) 室(部位)(以下简称该房屋)。该房屋 实测 (【出租】实测)建筑面积为 平方米,房屋用途 住宅 ,房屋结构为 钢混。甲方已向乙方出示:Party A shall lease Party B the Property situated at District (hereinafter referred to as “the Property”). The total gross area of the Lease Property shall be _square meters, the purpose

6、ghai Certificate of Ownership of the Property (Certificate No.).1-2甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 未 已/未)设定抵押。Party A being the Owner of the Property and Party B have developed a lessor/lessee relationship. Before the signing of this Contract, Party A has already i

7、nformed Party B that the Property is not subject to a mortgage.1-3该房屋的公用或合用部位的运用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。The area and the use of the public or common part of the Property; the existing fixtures, f

8、acilities, condition of equipment and the contents, standard and other relevant matters to be ascertained in relation to the fixtures and the facilities added by Party B with the consent of Party A shall be specified in Appendix 2, 3 of this Contract. Party A and Party B have agreed the said Appendi

9、x shall represent the condition of the Property at the time of hand over of the Property by Party A to Party B and when Party B deliver up the Property to Party A at the expiry of this Contract.二、租赁用途Purpose of the Property2-1乙方向甲方承诺,租赁该房屋作为 住宅 运用,并遵守国家和本市有关房屋运用和物业管理的规定。Party B warrants to Party A t

10、hat the Property shall be used for Residential purpose and follows the regulations of the State and this Municipality in relation to the use and management of Property.2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前,不擅自变更上款约定的运用用途。Party B guarantee that during the lease term, it shall not alter the purpose o

11、f the Property without Party As prior written consent as well as the approval from the relevant governmental department.三、交付日期和租赁期限Delivery Date and Lease Term3-1甲乙双方约定,甲方于 2009-06-12前向乙方交付该房屋。【出租】房屋租赁期自 2009-06-12起至2010-06-11止。Party A and Party B have agreed that Party A shall hand over the Propert

12、y to Party B before 2009-06-12 .LeaseThe lease term of the Property shall be from 2009-06-12 until 2010-06-11 。3-2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需接着承租房屋的,则应于租赁期届满前 一个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。Upon expiry of the lease term, Party A shall have the right to repossess the Property in its entirety and Party

13、 B shall deliver it up accordingly. If Party B wishes to renew the lease, it shall submit such intent in writing to Party A one months prior to the expiry of the lease and sign a new lease contract with the consent of Party A. 四、租金、支付方式和期限Rent, Method of Payment and Term 4-1甲、乙双方约定,【出租】人民币( 元 )(大写:

14、元整)。该房屋租金 1 (年)内不变。自第 2 (年)起,双方可协商对租金进行调整。有关调整事宜由甲、乙双方在补充条款中约定。Party A and Party B have agreed that.Lease The total monthly rent shall be RMB 15800Yuan.The rent shall remain unchanged for 1 year. The rent may be adjusted by both parties through consultation commencing from 2 year. Matters related to the adjustment shall be agreed by Party A and Party B in supplementary clauses.4-2乙方应于每月 10 日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按月租金的0.5 %支付违约金。Party B shall pay the rent by the 10 day of each month.
