11、eding up development is not opposed, but consistent, we should never be成都房屋维修基金管理办法及成都现行房屋基金收取比例成都市城市住房专项维修资金管理暂行办法第一章总则第一条为维护业主的合法权益,建立城市住房维修保障机制,加强住房专项维修资金管理,根据国务院物业管理条例,结合成都市实际,制定本办法。第二条本市城市规划区国有土地范围内住房专项维修资金的缴存、使用、管理和监督,适用本办法。第三条本办法所称住房专项维修资金(以下简称专项维修资金),是指专项用于物业保修期满后物业共用部位、共用设施设备的维修、更新、改造资金。本办法

12、所称业主,是指房屋所有权人。本办法所称共用部位,是指一幢房屋内部、由整幢房屋的业主、使用人共用的房屋主体承重结构、外墙面、门厅、楼梯间和其他在使用上、功能上为整幢建筑服务的部位等。本办法所称共用设施设备,是指物业管理区域或者单幢房屋内,由业主、使用人共用的上下水管道、电梯、供配电设施设备、消防及安全监控设施设备、公益性文体康乐设施、绿地、道路、路灯、非经营性停车场所和有关共用设施设备使用的房屋等。第四条拥有二个以上房屋所有权人的住宅物业、住宅小区内的非住宅物业或者与单幢住宅楼结构相连的非住宅物业的业主,应当按本办法规定统一建立专项维修资金。策五条专项维修资金实行统一缴存、专户存储、业主决策、专

13、款专用、统筹监管的原则。第六条市房产管理部门是本市专项维修资金的主管部门,负责对本市专项维修资金的统一归集和监督管理。区(市)县房产管理部门按规定权限负责本辖区内专项维修资金缴存、使用的监督管理。第七条房产管理部门应当建立投诉受理制度,接受业主、业主大会设立的业主委员会和物业管理企业对违反本办法行为的投诉。第二章专项维修资金的缴存第八条商品房的首次专项维修资金,由房地产开发建设单位和购房人分别按下列规定缴存:(一)房地产开发建设单位对配备电梯的房屋按每平方米建筑面积成本价的35缴存,对未配备电梯的房屋按每平方米建筑面积成本价的3缴存;所缴存的专项维修资金,进入当期销售费用,归物业管理区域内全体

14、业主所有。(二)购房人对配备电梯的房屋按每平方米建筑面积成本价的25缴存,对未配备电梯的房屋按每平方米建筑面积成本价的2缴存,该专项维修资金归购房业主所有。商品房每平方米建筑面积成本价,由市房产管理部门会同有关部门定期发布。第九条商品房的首次专项维修资金的缴存时限:(一)房地产开发建设单位应当在办理商品房所有权初始登记前,按本办法第八条第(一)项的规定,将该商品房的首次专项维修资金缴存至专户管理银行。(二)购房人应当在办理房屋所有权分户登记前,按本办法第八条第(二)项的规定,将所购商品房的首次专项维修资金缴存至专户管理银行。(三)业主大会成立时尚未出售的商品房,房地产开发建设单位应当在业主大会

15、成立之日起30日内,对配备电梯的房屋和未配备电梯的房屋,分别按每平方米建筑面积成本价的25和2,将首次专项维修资金缴存至专户管理银行。商品房出售时,所缴有的首次专项维修资金转由购房人承担。第十条公有住房售后的首次专项维修资金,由售房单位和购房人分别按下列规定提取和缴存:(一)售房单位对配备电梯的住房按售房款的30提取,对未配备电梯的住房按售房款的20提取,专款专用。(二)购房人按售房款的2缴存,该专项维修资金归购房业主所有。第十一条公有住房售后的首次专项维修资金的缴存时限:(一)售房单位自房改售房款存入单位住房资金专户之日起30日内缴存至专户管理银行。(二)购房人在办理房屋所有权登记前,缴存至

16、专户管理银行。第十二条房地产开发建设单位、公有住房售房单位在出售房屋时,应当与购房人在合同中约定首次专项维修资金缴存事项。申请办理房屋所有权登记的,应当向房屋产权登记机关提交专户管理银行出具的首次专项维修资金全额交款凭证。第十三条一幢或者一户房屋的专项维修资金余额不足首次专项维修资金的30时,该幢或者该户房屋的业主应当续筹专项维修资金。续筹专项维修资金的方案由业主委员会拟订,提交业主大会决定后,由业主委员会具体实施。第十四条利用业主依法享有的房屋本体共用部位、共用设施设备进行经营的,业主所得收益应当主要用于补充专项维修资金,并分摊计入该房屋业主的分户帐。利用业主依法享有的物业管理区域共用设施设备进行经营的,业主所得收益应当主要用于
