4、制约着国家权力的行使。在国家政治生活中扮演越来越重要的角色。本文试着就公民社会在塑造一个受控制的公共权力方面，从三个方面展开讨论。第一部分研究“公民社会”概念溯源。通过对公民社会概念的考察，分析古希腊时代以来公民社会概念的演进，全面认识公民社会的社会经济、政治功能。第二部分论述公民社会与宪政的关系。宪政是现代政治发展的基本目标，公民社会作为实现宪政的社会基础，以现实和保障公民权利为根本目标。是我国改革开放以后发展起来的重要社会力量，是社会经济、政治发展的产物。第三部分分析公民社会建设的基本方向。公民社会生成后，可以成为个我国社会主义民主政治、宪政建设的重要力量，但公民社会并非是其充要条件。因而

7、ngly important role in political life for the country .In this paper, a civil society in shaping the public power under control, started on three aspects. The first part is on the concept of civil society and traceability.Through the civil society concept of the study, evolute the concept of civil s
8、ociety since Old Greece Time, then recognize the basic functions of civil society in the socio-economic and political life . The second part of civil society discusses with the constitutional relationship.Constitutional development is the goal of modern politics, The civil society achievement realiz
9、es the constitutional government social basis, Civil society aims to achieve and safeguard citizens basic rights to the ultimate goal, is important social strength which our country reform and open policy later develops, is our country social economy, the political development product. After the formation of civil society,it can become Chinas socialist democratic politics, the constitutional construction of a major force. But civil society is not necessary and sufficient condition for it, How to guide the development

Keywords: civil society ；Democracy ； Statism ；Constitutional ； Public authority引言 宪政是现代政治发展的一个基本目标，是指以宪法为前提，以民主政治为核心，以法治为基石，以保障人权为目的政治形态或政治过程。宪政本质上是建立一种符合现代价值观的可控制的公共权力秩序。在讨论宪政建设的过程中，人们普遍注意到了存在于权力体系之外的一个重要社会力量，即公民社会。随着我国经济、政治体制改革的不断推进、社会主义市场经济体系的建立和逐步完善、社会利益结构的转型、社会自主性空间的扩大、多元文化的形成。一个逐步发展起来的公民社会在国家政治生活中开始扮演越来越重要的角色。一方面公民社会为个体公民提供组织化的政治参与渠道，成为公民个体的利益诉求平台，发挥“保护伞”功能。促进了公民自由与权利的实现，增强了社会的积极性和创造力。另一方面，公民社
