5、乙方为科技大学“国际访问教授”，乙方同意接受该等聘任。Party A agrees to engage Party B, and Party B accepts engagement by Party A as a Visiting Professor of University of Sciences and Technology in accordance with the terms and conditions of this Agreement and the Trial Regulations for University of Sciences and Technology “I
6、nternational Visiting Professor”1.2 聘任的性质1.2 Nature of Engagement本协议下的聘任并非旨在于甲方和乙方之间创立雇用劳动关系。相应的，乙方所享受的报酬和待遇应当仅限于本协议的规定。The engagement under this Agreement is not intended to create an employment relationship between Party A and Party B. Accordingly, Party B shall not be entitled to any remuneration
7、 and benefits other than those provided for under this Agreement.第二条 聘任期限本协议下的聘任为1年，聘期自 年 月 日开始，到 年 月 日结束，聘期内乙方每年在甲方工作不少于个月。Article 2 Term1.1 The term of engagement shall be one year, beginning onand ending on. 8、A.第三条 乙方的职责Article 3 Duties of Party B3.1 工作范围 3.1 Scope of Work乙方应在本协议期限内按照甲乙双方同意的工作计划为甲方工作。Party B shall work for Party A during the term of this Agreement according to the work plan agreed upon between Party A and Party B.3.2 工作评审 3.2 Work Review乙方的工作和研究应当接受甲方的评审。Party B shall have his/her work a
9、nd research subjected to review by Party A.第四条报酬 Article 4 Remuneration4.1数额及支付方式4.1 Rates and Payment Terms除非本协议提前解除，乙方完成约定的工作量（包括工作时间），甲方将向乙方提供金额为税前元人民币/月（按实际工作天数计算），作为其工资薪酬。甲方将承担乙方一次往返国际机票（经济舱）。If Party B accomplishes his/her responsibilities (including the working time), Party A shall provide Pa
10、rty B with RMByuan per month (before tax) (unit: day), to cover his/her salary. Party A will provide Party B an economy class round-trip ticket.4.2 费用的报销4.2 Reimbursement of Expenses甲方可为乙方报销其为履行本协议下的职责所产生的合理的费用。Party A may reimburse reasonable expenses incurred by Party B in connection with the fulf
11、illment of his/her duties under this Agreement.4.3 税及扣减4.3 Taxes and Deductions乙方应当承担所有对其适用的所得税和法律要求的扣减。甲方应当依照相关法律法规的要求替乙方代扣相应的税款。Party B shall be responsible for all the income taxes applicable to him/her and such other deductions as required by Chinese law. Party A shall be responsible for withhol
12、ding such taxes and deductions for Party B in accordance with the requirement of relevant laws and regulations.第五条 假期和病假Article 5 Vacation and Sick Leave乙方应按照中国的法律和甲方的内部规章制度享受假期和病假。Party B shall be entitled to vacations and sick leaves according to Chinas statutory laws and Party As internal rules.第
13、六条乙方的义务Article 6 Party Bs Obligations乙方在本协议期间内应履行以下义务：a) 遵守中国的法律法规及中国科学技术大学的有关规定。b) 乙方应当遵守甲方制定和不时修改的适用于其雇员或者是具有同类职责的访问学者的所有规章制度。c) 乙方提供其所在国家和地区的驻华使馆承认的健康证明。Party B shall, during the term of this Agreement, fulfill the following obligations:a) Party B shall abide by the laws and regulations of China
14、and the rules and regulations of USTC.b) Party B shall abide by all the rules and guidelines provided and amended from time to time by Party A for all its employees or visiting scholars having comparable duties.c) Party B shall submit the health certificate, provided by the medical institution recog
15、nized by local Chinese embassies and consulates.第七条 甲方的义务Article 7 Party As Obligations甲方在本协议期间应当协助乙方获取为中国法律所要求的乙方进入、离开中国和在中国居住、工作所必须的许可和批准，并且应当为乙方提供开展本协议下的研究项目所必须的工作条件。Party A shall, during the term of this Agreement, assist Party B in securing permits and approvals required by Chinese law that are necessary for Party Bs entry into, exit from, living and working in China and provide Party B with working conditions that are necessary for Party B to carry out the research project under this Agreement.第八条保密Article 8 Confidentiality非经甲方事前书面同意，乙方不得将其获得的或者是知道的甲方的秘密信息披露给任何人。该等
