2、国强制隔离戒毒的法律研究 类别（领域）：法学 学位申请人：XXX 指导教师：XXX教授 摘 要 当前，毒品滥用问题在我国日益严重，已成为影响社会安好稳定的重要因素。2022年出台的中华人民共和国禁毒法融合了公安强制、劳教戒毒两种传统戒毒模式，在重构我国戒毒体制根基上，第一次设立了 “强制隔离戒毒”制度。禁毒法实施以来，强制隔离戒毒作为一种特意针对我国吸毒成瘾人群实施的戒毒模式，对遏制我国毒品滥用问题发挥了重要作用，对维护我国社会稳定意义重大。然而，强制隔离戒毒制度也因禁毒法、禁毒条例中相关立法的不完善，未对传统戒毒体系的敝端举行必要的改革，使得我国强制隔离戒毒制度在概括实施存在一些亟待解决的问
3、题，本文针对这些问题提出了一些完善该制度的建议。 本文首先以强制隔离戒毒的一般理论为启程点，概述了强制隔离戒毒模式的法律特征和本质，对该模式和其他禁毒模式的识别和联系举行了提炼和总结，阐述了强制隔离戒毒制度在我国戒毒体系中的地位和作用； 结合禁毒法、禁毒条例等相关法律文件以及该制度实际运行过程中的处境，理论联系实际，从法律实施主体、救济途径等五个方面分析了当下我国强制隔离戒毒体系存在的法律问题。结果，通过对域外国家和地区的类似戒毒模式举行借鉴和对比，提出完善强制隔离戒毒制度的相关想象。 在我国现有的戒毒模式中，强制隔离戒毒的地位举足轻重。虽然强制隔离戒毒制度在立法层面存在缺陷，但不能全盘否决其
4、在我国现行戒毒工作中发挥的积极作用。我们应当立足我国概括国情，专心总结强制隔离戒毒制度立法中存在的问题，同时借鉴域外国家和地区的先进做法和告成阅历，以降低复吸率、保障人权、促进禁毒工作法治化为目标，从加强执法主体权力制约、畅通法律救济渠道、保障戒治人员合法权益、侧重戒毒过程医疗性质、强化检察监视机制等五个方面对该制度举行“革新”和完善，让强制隔离戒毒制度真正表达 “权责统一，程序正值，以人为本、科学戒毒”的戒治原那么，更好的提升我国戒毒工作的社会效果和法律效果。 关 键 词：强制隔离戒毒； 禁毒法；戒毒模式 论文类型：应用研究 Title: Perfecting Legal Research

The “Peoples Republic
6、 of China Anti-Drug Law“ promulgated in 2022 incorporates two traditional modes of detoxification, including compulsory public security and reeducation through labor, and has established the “compulsory isolation and detoxification“ system for the first time on the basis of reconstructing Chinas dru
7、g treatment system. Since the implementation of the Anti-Drug Law, the compulsory isolation of drug addiction as a form of detoxification specifically targeted at drug addiction groups in China has played an important role in curbing the problem of drug abuse in China and is of great significance to
8、 safeguarding social stability in our country. However, due to the imperfections in the relevant laws in the Anti-Drug Law and the Anti-Drugs Regulations, the compulsory isolation drug treatment system has not carried out the necessary reform of the traditional anti-drug system, which has caused som
9、e urgent needs for the implementation of the compulsory isolation drug treatment system in China. This paper proposes some suggestions for improving the system in response to these problems. This article begins with the general theory of compulsory isolation and treatment of detoxification. It outli
10、nes the legal characteristics and nature of the compulsory isolation detoxification model, refines and summarizes the differences and links between this model and other anti-narcotics models, and expounds the compulsory isolation drug rehabilitation system in China. The position and role of the syst
11、em; combined with relevant laws and documents such as the Anti-Drug Law and the Anti-Drug Ordinance, and the actual operation of the system, the theory is linked to reality, and the current situation in China is analyzed from five aspects: the main body of law enforcement and the relief approach. Th
12、ere are legal issues in the compulsory isolation and detoxification system. Finally, through reference and comparison of similar detoxification models in countries and regions outside the region, the author proposes relevant concepts for improving the compulsory isolation and detoxification system.
13、In the existing mode of drug treatment in our country, the status of compulsory isolation and detoxification plays an important role. Although the compulsory isolation drug treatment system has flaws at the legislative level, it cannot completely deny its active role in the current drug treatment wo
14、rk in China. We should base our countrys specific national conditions, conscientiously sum up the problems in the legislation of the compulsory isolation drug rehabilitation system, and draw on the advanced practices and successful experiences of foreign countries and regions to reduce the relapse r
15、ate, safeguard human rights, and promote the rule of law of anti-drug work. Strengthen the power constraints of law enforcement subjects, smooth access to legal relief channels, safeguard the legitimate rights and interests of drug addicts, lay emphasis on the medical nature of drug treatment, stren
