4、,各国纷纷强化法律手段予以解决。在刑事法领域,惩罚环境犯罪的危险犯已成为西方发达国家环境刑事立法的共同发展趋势。然而,我国现行刑法只惩罚破坏环境资源犯罪的结果犯而无危险犯规定,这种状况已经明显不能满足我国生态文明建设的现实需要。本论文旨在探讨我国刑法设立环境危险犯的理论基础和制度设计,并就将来司法中环境危险犯认定中可能出现的问题予以解析。第一部分是对环境危险犯概述。笔者认为,环境危险犯是指以行为人实施的危害行为造成的危险结果作为犯罪构成必要条件的犯罪。其主要特征有:危险必须是客观的现实的;主观方面可以为故意或过失;有结果加重状态等等。理论上,具体危险犯与抽象危险犯是危险犯中最重要的一组分类。第

5、二部分论证了我国环境犯罪中设立危险犯的理论根据。传统刑法理论中的损害原则与允许的危险理论面对现代环境保护需要具有极大的障碍必须予以摒弃,而现代环境法价值理念包括可持续发展理论以及风险预防原则与环境犯罪的特殊性及严重社会危害性都决定了设立环境危险犯的必要性。刑法的保障法地位、其他犯罪危险犯的立法例及国外立法经验为设立环境危险犯的可行性给予了强力支持。同时,设立环境犯罪的危险犯与谦抑性不矛盾。第三部分我国环境犯罪中设立危险犯的立法及司法认定问题分析。根据环境犯罪的特征,结合国外立法经验,建议在我国刑法相关部分分别设立具体危险犯与抽象危险犯;主张谨慎地设立过失危险犯;设立法人危险犯,实行双罚制。危险

6、标准的判断是环境危险犯的司法认定关键问题,其应该根据一般人与科学的标准相结合的原则判断,并同时采用允许被告人反证的法律上的推定 原则。关键词:危险 环境危险犯 传统刑法 现代环境法 谦抑性.XX科技大学硕士学位论文摘要.ABSTRACTWith the global economics developing highly, the environmental pollution problems arebecoming more and more serious, and every country in the world resolve the environmentalproblems

7、by the political, economical and technological measures, also the legal measures, and one after another. Punishing the dangerous criminals ofenvironmental pollution crimes have been the common developing trend of environmentallegislations in several countries in the whole word. However, we only puni

8、sh the resultedcriminals without the regulations of dangerous criminals in environmental law in our country,which make our environmental criminal law obviously lag behind. This thesis aims to researchthe theoretical basis of setting up the environmental dangerous criminals in our country, andput for

9、ward the concrete and feasible suggestions for legislative and judicial regulations.The first part definites the concept, classification and characteristics of the environmentaldangerous criminals.
