12、stination.索赔条款：DiscrepancyandClaimAnyclaimbytheBuyersregardingthecargoshallbesupportedbysurveyreporti ssuedbyasurveyorapprovedbytheSellerandlodgedwithin45daysafterthearri valofthecargoattheportofdestinaton.TheSellerwillnotconsiderclaimsinresp ectofmatterswithinresponsibilityofinsurancecompanyorshipp
13、ingcompany.ShouldtheSellerfailtomakedeliveryontime,thebuyershallagreetopostponet hedeliveryontheconditonthattheSelleragreesofpayapenaltywhichshallbede ductedbythepayingbankatthetimeofpayment.Therateofpenaltyischargedat 0.5%ofthetotalvalueofthecargowhosedeliveryhasbeendelayedforeverywee k,odddaysless
14、thanaweekshouldbecountedasaweek.Butthetotalamountofpe naltyshallnotexceed5%ofthetotalvalueofthecargoinvolvedinthelatedeliver y.IncasetheSellerfailotmakedelivery10weekslaterthanthetimeofshipmentst ipulatedonthecontract,theBuyershallhavbetherighttocancelthecontractandt heSellershallstillpaytheaforesai
15、dpenaltytotheBuerwithoutdelay.Quality/QuantityDiscrepancyandClaim:Incasethequalityand/orquantity/weightarefoundtheBuyerstobenotinconfor mitywiththeContractafterarrivalofthegoodsattheportofdestination,theBuye rsmaylodgeclaimwiththeSellerssupportedbysurveyreportissuedbyaninspec tionorganizaitonagreedu
16、ponbybothparties,withtheexception,however,ofth oseclaimsforwhichtheinsurancecompanyand/ortheshippingcompanyaretob eheldresponsible.ClaimforqualitydiscrepancyshouldbefiledbytheBuyerswi thin30daysafterarrivalofthegoodsattheportofdestination,whileforquantity/ weightdiscrepancyclaimshouldbefiledbytheBuyerswithin15daysafterarrivalofthegoodsatpor
