PartyBsobligations 1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesernmentandshallnotinterfereinChinasi
4、nternalaffairs. 2.PartyBshallobservePartyAsworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyAsarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyAsconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagr
5、eedonwithPartyA. 3.PartyBshallpletethetasksagreedonscleandguaranteethequalityofwork. 4.PartyBshallrespectChinasreligiouspolicy,andshallnotconductreligiousactivitiesinpatiblewiththestatusofanexpert. 5.PartyBshallrespecttheChinesepeoplesmoralstandardsandcustoms. Revision,CancellationandTerminationofth
6、eContract 1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent. 2.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved. 3.PartyAhastherighttocance
7、lthecontractwithawrittennoticetoPartyBunderthefollowingconditions; (1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout. (2)Accordingtothedoctorsdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysi
8、ckleave. 4.PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions: (1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract. (2)PartyAhasnotpaidPartyBasscled. BreachPenalty Wheneitherofthetwopartiesfailstofulfillthecontractorfai
9、lstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpayabreachpenaltyofUS$500to2,000(ortheequivalentinRMB). IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyAsconsent,andpayitsownreturne
10、xpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyBsreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyBsreturnexpense
11、sandpayabreachpenaltytoPartyB. Theappendixofthiscontractisaninseparablepartofthecontractandhasequaleffect Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty90dayspriortoth
12、eexpirationofthecontract,andsignthenewcontractwithmutualconsent.PartyBshallbearallexpensesincurredwhenstayingonafterthecontractexpires. Arbitration Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtothanizationofarbitrationforforeignexpertsaffairsintheStateAdministrationofForeignExpertsAffairsandaskforafinalarbitration.
