3、ustrialdesign?1.1.1OfWIPOAnindustrialdesignistheornamentalofaestheticaspectofanarticle.Thedesignmayconsistofthree-dimensionalfeatures,suchastheshapeorsurfaceofanarticle,oroftwo-dimensionalfeatures,suchaspatterns,linesorcolor.Industrialdesignsareappliedtoawidevarietyofproductsofindustryandhandicraft.
4、Tobeprotectedundermostnationallaws,anindustrialdesignmustappealtotheeye.Thismeansthatanindustrialdesignisprimarilyofanaestheticnature,anddoesnotprotectanytechnicalfeaturesofthearticletowhichitisapplied.DesigninthePatentLawmeansanynewdesignoftheshape,thepatternortheirbination,orthebinationofthecolorw

6、rtyInChina,Intellectualpropertycanbegenerallyclassifiedaspatent,copyright,trademark.Patents,orinotherwords,inventions-creations,meaninventions,utilitymodelsanddesigns.Sothatthedesignsareoneofthesubdivisionsofpatents.Whereas,inCanada,inadditiontoindustrialdesigns,thereotherformsofintellectualproperty
7、,aspatents,copyrights,andintegratedcircuittopographies.Hereby,patentscovernewinventions(process,machine,manufacture,positionofmatter),oranynewandusefulimprovementofanexistinginvention.Sothatindustrialdesignshavetheequalstatuestopatents,asoneofthesubdivisionsofintellectualproperty.1.3Whyprotectindust
8、rialdesigns?Industrialdesignsarewhatmakeanarticleattractiveandappealing;hence,theyaddtothemercialvalueofaproductandincreaseitsmarketability.Whenanindustrialdesignisprotected,theowner-thepersonorentitythathasregisteredthedesign-isassuredanexclusiverightagainstunauthorizedcopyingorimitationofthedesign
9、bythirdparties.Thishelpstoensureafairreturnoninvestment.Aneffectivesystemofprotectionalsobenefitsconsumersandthepublicatlarge,bypromotingfairpetitionandhonesttradepractices,encouragingcreativity,andpromotingmoreaestheticallyattractiveproduct.Protectingindustrialdesignshelpseconomicdevelopment,byenco
10、uragingcreativityintheindustrialandmanufacturingsectors,aswellasinthetraditionalartsandcrafts.Theycontributetotheexpansionofmercialactivitiesandtheexportofnationalproducts.Industrialdesignscanberelativelysimpleandinexpensivetodevelopandprotect.Theyarereasonablyaccessibletosmallandmedium-sizedenterpr
11、isesaswellastoindividualartistsandcraftsmen,inbothindustrializedanddevelopingcountries.1.4Howcanindustrialdesignsbeprotected?Inmostcountries,anindustrialdesignmustberegisteredinordertobeprotectedunderIndustrialDesignLaw.AsforChina,theregulationsondesignareunderthePatentLawofPeoplesRepublicofChina(PR
12、C)anditsimplementingregulations;AsforCanada,TheIndustrialDesignActandIndustrialDesignRegulationsdetailstheregulationsthatgoverndesignrights.Asageneralrule,toberegisterable,thedesignmustbe“new”or“original”.Differentcountrieshavevaryingdefinitionsofsuchterms,aswellasvariationsintheregistrationprocessi
13、tself.Generally,“new”meansthatnoidenticalorverysimilardesignisknowntohaveexistedbefore.Dependingontheparticularnationallawandthekindofdesign,anindustrialdesignmayalsobeprotectedasaworkofartundercopyright.2.Themaindifferenceconcerningregistration2.1WhentofileanapplicationThereisnotimelimitforfilingan
14、applicationaslongasthedesignhadneverbeenpublished.Theterm“published”meansthatthedesignhasbeenmadepublic(eventoyourneighbors)orofferedformercialsaleoruseanywhereintheworld.Itisbesttofileanquicklyaspossibleifpublicationhasoccurred.InCanada,thedesignshallberefusedtoberegisterediftheapplicationisfiledmo
15、rethanoneyearafterthepublicationofthedesigninCanadaofsomewhere.2.2whocanapply?2.3Whatrequirementstomakedesignsregisterable?InCanada,theministershallregisterthedesigniftheministerfindsthatitisnotidenticalwithordosenotsocloselyresembleanyotherdesignalreadyregisteredastobeconfoundedtherewith,andshallre
16、turntotheproprietorthereofthedrawingorphotographanddescriptionwiththecertificaterequired.InChina,anydesignforwhichpatentfightmaybegrantedmustnotbeidenticalwithandsimilartoanydesignwhich,beforethedateoffallinghasbeenpubliclydisclosedinpublicationsinthecountryorabroadorhasbeenpubliclyusedinthecountry,andmustnotbeinconflictwithanypriorrightofanyotherperson.2.4Whatyoucannotregister?InChina,foranyofthefollowing,nopatentrightshallbegranted:1scientificdiscoveries;2rulesandmethodsformentalacti
